HomeMy WebLinkAboutCity Council Ordinance 1979-16CITY OF PLYMOUTH ORDINANCE NO. 79-16 AN ORDINANCE RELATING TO MISDEMEANORS; AMENDING SUBSECTION 2000.03, SUBD. 7 AND SUBSECTION 2005.01 OF THE PLYMOUTH CITY CODE THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of City Code. Subsection 2000.03, Subd. 7 is amended by adding the following thereto: "(3) Be present in a disorderly house of plane of public resort kept for illegal purposes, including but not limited to prostitution, illegal gambling, illegal sale or consumption of intoxicating or non - intoxicating liquor, or illegal sale or use of contraband substance." Section 2. Amendment of City Code. Subsection 2005.01 is amended to read as follows: "2005.1 Making Unnecessary Noise. Subdivision 1. General Rule. I No person, in any public or private place, shall make, or assist in making, ! ;. by any manner.or means, any loud, unpleasant or raucous noise or odor ' disturning the others unless the same be reasonably necessary to the preservation of life, health, safety or property. Subd. 2. Noise in Residential Areas. No person shall, between the hours of 10:00 p.m. and 7:00 a.m., congregate because of or partici- Pate in any party or gathering of people from which noise emanates of a sufficient volume as to disturb the peace, quiet or repose or persons residing in any residential area. (a) A police officer may order all persons present other than the owners on tenants of the building or place to immediately disperse. Any person who shall refuse to leave after being ordered to do so by a police officer shall be guilty of a violation of this section. (b) Any owner or tenant of the building or place who has has knowledge of the disturbance and fails to immediately abate said disturbance shall be guilty of a violation of this section. Subd. 3. Unlawful Assembly on Private Property. No group of three . or more persons sha gather, assemble or congregate for any .purpose on private property which is not owned by one of them or with regard to:which one of them is not legally entitled to possession without written permis- sion of the owner of such=property or the person who is legally entitled to possess such property after having been ordered`to disperse.
