HomeMy WebLinkAboutCity Council Ordinance 1979-10CITY OF PLYMOUTH ORDINANCE NO. 79 - 10 AN ORDINANCE RELATING TO PUBLIC SAFETY; AMENDING SECTION 915.17 OF THE PLYMOUTH CITY CODE THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: Section 1. Section 915.17 of the City Code is hereby amended by adding Subdivision 4 thereto as follows: 915.17 Dog Bites. Subdivision 4. Destruction of dangerous animals. The City Manager or his or her appointee is authorized to order the destruction or disposition of any animal which he or she may deem dangerous. For the purpose of this section, any animal which has bitten a person on two (2) or more occasions shall be deemed a dangerous animal. The City Manager, or his or her appointee, after having been advised of the existence of such animal shall proceed in the following manner: (a) The owner of the offending animal shall be notified in writing as to the dates, times, places, and persons bitten, and shall be given ten (10) days to request a hearing before the City Manager or his or her appointee for a deter- mination as to the dangerous nature of the animal. If the owner does not request'a hearing within ten (10) days of said notice, the City Manager or his or her appointee shall make such order as he or she deems proper;.,He or she: may order the animal warden A:o take the animal into custody for destruction in which' -case the owner shall immediately make the 'animal available tothe animal warden. (b) If the owner requests a heariIng, for, determinotion as to. the dangerous nature of the aminal, the hearing shall be held' before 'the City Manager.or=his or her appointee, at Z a sa sh fo Z
