HomeMy WebLinkAboutCity Council Ordinance 1978-16CITY OF PLYMOUTH ORDINANCE N0, 78-16 AN ORDINANCE AMENDING SECTION 9.07 OF THE CITY CODE RELATING TO CONVEYANCES BY METES AND BOUNDS The City Council of the City of Plymouth does hereby ordain as follows: Section Amendment of City Code. Section 9.02 of Chapter VII of the City Code is hereby amended to read as follows: "9.02. Conveyance by Metes and Bounds. No conveyance of land in which the land conveyed is described by metes and bounds shall be made or recorded if the parcels described in the conveyance are less than five (5) acres in area and three hundred (300) feet in width, or if the conveyance results in a division into two or more lots or parcels and any of which are less than five (5) acres in area and three hundred (300) feet in width, unless such parcel is a separate parcel of record at the effective date of this Ordinance. or unless an agreement to convey such smaller parcel has been entered into prior to such time and the instruments showing the agreement to con- vey is recorded in the office of the Register of Deeds within one year thereafter. In any case in which compliance with the foregoing provision will involve an unnecessary hardship, such con- veyance shall be presented to the Planning Commission in the form of a preliminary plat in conformance with the standards set forth for preliminary plats, and the Planning Commission shall first approve the arrangement, sizes and rel'tionship of proposed tracts, and tracts to be used as easements or roads shall be so designated. Unless City Council approval in accordance with the standards set forth in this Ordinance has been obtained, building permits will be withheld for buildings on tracts which have been subdivided and conveyed by this method and the City may refuse to take over tracts as streets or roads or to improve, r.'pair or maintain any such tracts. With respect to parcels of land of five (5) acres in area or more and three hundred (300) feet in width or more, no building or structure shall be coi:structed or erected on such parcels, nor shall any building per- mit be issued for the construction or erection of any building or structure on said parcels unless such parcels are abutting on a public street." 7 / Section 2, Effective Date' This ordinance shall be ) � effective upon its passage by the City Council. � Adopted by the City Council of the City of Plymouth on / the 17th day of July, 1078.
