HomeMy WebLinkAboutCity Council Ordinance 1978-15CITY OF PLYMOUTH ORDINANCE NO. 78-15 AN ORDINANCE AMENDING PORTIONS OF SECTION 9 OF CHAPTER VIII OF THE CITY CODE RELATING TO RULES AND REGULATIONS FOR WATER SERVICE THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FULLOWS: Section 1. Section 9.12 of Chapter VIII of the City Code is hereby amended to read: ":9.12. Water Rates. (a) The rate due and payable to the City by each water user within the municipality for water taken from the water supply system shall be as follows: (1) Account Charge. A charge of 31.50 per month shall be ma&e to every water account to defray administrative and billing costs of the City. (2) Volume Charge. A charge of $.42 per one thousand gallons of water used shall be made to ®ch water account. In those instances where there is no adequate water meter history, the measure of usage shall be that used for similar classes of property similarly situated. In case the meter is found to have stopped or to be operating in a faulty manner, the amount of water used will be est'onated in accordance with the amount used previously. (b) When water is desired for construction pur x,•ses or ether temporary uses, the owner shall make application in the renular way and on the regular form to be furnished by the municipality. (c) Water bills shall be mailed to the customers and shall specify the water consumed or estimated to have been consumed and the charge in accordance with the foregoing rates. (d) Where a connection is made to an automatic sprinkler system, stand pipe for standby service only, or a fire hydrant on private property, meters or detector check valves must be installed on such services as required by the municipality. Should it be found that water not metered is used through a fire connection for any purpose other than the extinguishing of fire upon the premises, the owner and occupant will be notified, and if such improper conditions are not corrected within ten (10) days, the water will be shut off until proper adjustments are made and the owner shall be subject to the penalties as provided in this ordinance. Regular inspections shall be made of all fire service connections with all piping, fire gates and other attached appurtenances. Employees of the Water Department shall have access to the premises for such inspection and shall keep a record of all inspections made. (e) Rates due and payable to the municipality by each water user located beyond the territorial boundaries of the municipality shall be on the same basis as specified in Paragraph A above plus 50% in each case." Ordinance No. t E f g .Section 2. Section 9.13 of Chapter VIII of the City Code is hereby amended to read: r "9.13. Water Availabiliiy Charge. A water availability charge at the rate of $1.20 per month s due and payable by the owner ++ of each lot or parcel of land which has municipal water service available if such lot or parcel is not connected to the municipal water system; provided, this charge is not due if there is no building or other structure on such lot or parcel." Section 3. Section 9.14 of Chapter VIII of the City Code is hereby amended to read: "9.14. Delinquent Water Accounts. All charges for water shall be due on the dates specifiedy the Finance Department for the respective account, and shall be delinquent thereafter. A penalty of 1% per month shall be added to all delinquent accounts. It shall be the duty of the Finance Department to endeavor to promptly collect delinquent accounts. For good cause shown the Finance Director may, in appropriate cases, waive the penalty imposed on such accounts. Annually all delinquent accounts shall be certified to the City Manager who shall prepare an assessment roll providing for assessment of the delinquent amounts against the respective properties serv,:d. This assessment roll shall be delivered to the City Council for adoption on or before October 1 of each year. Such action may be optional or subsequent to taking legal action to collect delinquent accounts." Section 4. This ordinance shall take effect upon its passage and publication.
