HomeMy WebLinkAboutCity Council Ordinance 1977-14CITY OF PLY SOUTH ORDINANCE NO. 77-14 AN ORDINANCE AMENDING SECTIONS OF CHAPTER V OF THE CITY CODE RELATING TO THE ;OPERATION OF MOTOR BOATS ON HADLEY LADE THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of City Code. Section 5 of the City Code is ;;hereby amended by adding the following thereto as Section 5.10: it 5.10 Hadley Lake. (a) Definitions. The following words and phrases when used in this section have the meanings as set out ;f herein. ! (i) "Boat' is any watercraft as defined in Minnesota Statutes 361.02. (ii) "Motorboat" means any watercraft propelled in any respect by machinery, including watercraft temporarily equipped with detachable motors. h (iii) "Hadley Lake" (#27-109) is that body of water which bears that name and is located in T. 118, R. 22 if wholly within the boundaries of the City of Plymouth. } (iv) "Person" includes an individual, partnership, corporation or any body of persons, whether incorporated or formed into an association or not. it (b) Limitations on Boats and Boating. In the interests of f the public health safety and general welfare, the (� following regulations and limitations are hereby imposed upon all boats operated, placed or maintained in or upon Hadley Lake: (i) No person shall operate, place or maintain any motor boat in or upon Hadley Lake. (ii) No person in charge of or occupying a boat shall dump or throw garbage, paper, bottles, cans, refuse or debris into Hadley Lake. !I (iii) No person shall operate a boat on said lake in such !; a manner as to violate any of the provisions of Minnesota Statutes Chapter 361 or the regulations of the Department of Natural Resources which statutes and regulations are hereby adopted and incorporated herein and made a part hereof as though fully set forth in this point. (iv) Any conduct in violation of any of the above provisions shall hereby be declared to be a nuisance. Ordinance No. Page 2 .r Section 2. Enforcement. Notwithstanding anything herein to the contrary, officers of the Plymouth Police Department shall be authorized W and entitled to enforce the provisions of this Ordinance. i Section 3. Penalties. Any person who shall violate any of the { provisions of this Ordinance shall be guilty of a misdemeanor, and upon 0 conviction thereof shall be punished by a fine of not more than $300.00 a J. or by imprisonment for not more than 90 days, or both. Section 4. Effective Date. This Ordinance shall become effective upon its passage and publication. Adopted by the City Council the 20th day of June 1977. f?
