AN ORDINANCE AaIENDING CHAPTER V OF THE CITY CODE BY ADDING SECTION 15
THERETO RELATING 10 THE REGULATION OF TRAPPING WITHIN THE CITY OF PLYMOUTH
THE CITY COUNCIL OF INE CITY OF PLYMOUTH DUES HEREBY ORDAIN AS FOLLOWS:

Section 1. Amendment of Ordinance. Chapter V of the City Code
is hereby amended by adding Section 15 thereto as follows:
"CHAPTER V, MISDEMEANORS AND OFFENSES AGAINST PUBLIC
HEALTH, SAFETY, WELFARE AND MORALS.
Section 15. Trapping.
15.01. Definitions.
(1) "Trap" shall mean any mechanical device, snare,
artificial light, net, bird line, ferret, hawk, vehicle
or contrivance used to trap, catch, snare, kill or other-
wise retrain the free movement of any nondomestic animals,
wilalife or birds.
(2) "Trapping" shall mean the setting, laying or
otherwise using a trap to catch, trap, snare, kill or
otherwise restraing the free movement of nondomestic
animals, wildlife or birds.
15.02. Trapping Prohibited - Platted Areas.
All trapping on private property within or upon platted
lands in the City of Plymouth is hereby prohibited except:
(1) when - the owner of such private property has
expressly consented to allow trapping thereon and
(2) upon the issuance by the Chief of Police of a
permit therefor after a showing that such trapping is
necessary to eliminate a nuisance.
15.03. Trapping Prohibited - Unplatted Areas.
All trapping on private property within or upon unplatted
lands in the City of Plymouth is hereby prohibited unless the
person engaged in such trapping has received written permission
from the owner of such private property to allow trapping thereon.
15.04. Exceptions_. t
The provisions of this ordinance do not apply:

(1) To persons who may employ a trap on their own private
property to prevent an unsafe condition or the waste or
destruction of their property when such persons have complied
with the laws of the State of Minnesota.
(2) To representatives of the City of PIynicluth,
County of Hennepin or State.of Minnesota who may, in the
course of -their duties, be required to use a trap to
catch, trap, snare, kill or otherwise restrain thio free
movement of any animal, wildlife or birds for humane or
other authorized purposes.
(3) To teachers for school programs or to scientists
intending to identify animals, wildlife or birds and then
return them to their natural environment.
15.05. Penalty.
Any person, firm, group, association, corporation or
other organization violating the provisions of this ordinance
shall, upon conviction, be punished for each separate con-
viction by a fine not to exceed $300.00 or by imprisonment
for a period not to exceed 90 days."
Section 2. Effective Date. this ordinance shall become
effective upon its passage and publication.
