ORDINANCE NO. 75-17
AN ORDINANCE AMENDING SECTION 8.05 OF CHAPTER VII
OF THE CITY CODE TO,PERMIT A,WAIVER OF REQUIRE-
MENTS FOR CITY PARTICIPATION IN THE INSTALLATION
OF UTILITIES IN CERTAIN RESIDENTIAL DEVELOPMENTS
THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. Amendment of City Code. Section 8.05 of
Chapter VII of the City Code is hereby amended by adding the following.
thereto as Sub -Paragraph (a)(6) thereof:
*8.05. PARTICIPATION OF CITY
(a) Residential Developments.
(6) The City Council, in its discretion,
nay waive the requirements of Sub -paragraphs
(1), (2) 'and (3) above with res ct to the
development of such lands and properties if all of i
ihe'lollowing conditions 'a -re mait'
a. The owner and subdivider
must reside on the property -
being developed and such property
must have been classified for
tax purposes as the owner and
subdivider's homestead..
b. The division of.the property must
include the entire property,
meet the requirements of the
Soo brdinainde 'for, A ivision of
Vroperty '4nd, suchdivisiori must
be--achieved'by an approved and
recordable plat.
C. The individual parcels resulting -
from such
esultingf==.such a plat shall be for
single family residential use only
and each such parcel shall be of such
sine, configuration and tolpo-
graphical quality as to be. capable
of',laccommodatipq a single family
residential structure.
d. The individual parcels resulting
from such a plat shall be no more than
five in number including any parcel
retained by,the owner and subdivider
as his homestead.
a. The requirements of Sections 4
'through -8 of this chapter of the
City Code shall be;,applicable to, any
such division of lands and properties*
f. Lands and properties abutting land
and property being so divided
shall themselves have previously
been platted and divided, it
toeing the intent not to waive
the requirements of Subparagraphs
(1), (2). and (3) above with
respect to land in undeveloped
areas of the City.
g. The estimated market value of
each parcel as determined by the
City Assessor following such
division of land and property must ex-
ceed the amount of special assessments
previously levied and allocated to
each parcel including the amount of
assessments estimated to be levied
against each such parcel as a result
of the improvements required to be
installed in accordance with this section
of the City Code by reason of such
division of land and property."
Section 2. Effective Date. This ordinance shall take effect
upon its passage and publication.
Adopted by the City Council the 15th day of December ,
1975.
