HomeMy WebLinkAboutCity Council Ordinance 1975-09ORDINANCE NO. 75-9 CITY OF•PLYMOUTH AN ORDINANCE AUTHORIZING THE ISSUANCE OF ON -SALE WINE LICENSES, AS AUTHORIZED BY LAWS OF 1975, CHAPTER 345, ADDING A NEW SUBSECTION 4.20 to CHAPTER III OF THE CITY CODE OF THE CITY OF PLYMOUTH THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of City Code. Chapter III of the City Code is hereby amended by adding a new subsection to read: "4.20. On -Sale Wine Licenses. (a). Definitions. The following words and terms when used in this subsection shall have the following meanings: (i). An "on-sale'wine license" is a license authorizing the sale of wine not exceeding 14% alcohol by volume, for consumption on the licensed premises only, in conjunction with the sale of food. (ii). "Restaurant"means an establishment, under the control of a single proprietor or manager, having appropriate facilities for serving meals and seating not fewer than 25 guests, and where, in con- sideration of payment therefor, meals are regularly served at tables to the general public, and which employs an adequate staff to provide the usual and suitable service to its guests. (b). Application for an on -sale wine license shall be made in the manner specified in Section 4.05. On -sale wine licenses may be granted only to restaurants as defined herein. (c). The annual license fee for an on -sale wine license shall be two thousand ($2,000.00) dollars payable v a?i Crdinance No. 75-9 Page 2 in two equal installments in advance on the first day of February of each year and again on the first day of August of each year. When any license is issued for an unexpired portion of a license year, the fee shall be prorated and a receipt from the City Treasurer for the portion of the license fee due shall accompany the application. Failure to pay the second installment of the li- cense fee promptly when due shall be cause for revocation of such license without notice. (d). Sales under an on -sale wine license are subject to the restrictions on days and hours specified in Section 4.16. Sales may also be made between the hours of 12 o'clock noon and 12 o'clock midnight on Sundays provided the licensee has obtained a license for Sunday sales as provided in Section 4.16.1 herein except that the seating capacity required shall be for 25 guests. (e). The following sections apply to on -sale wine licenses: 4.02; 4.03; 4.05; 4.06, except the amount of the bond shall be $2,000.00; 4.10; 4.11, except that no on -sale wine license shall be effective until approved by the State Liquor Control Commissioner; 4.12; 4.13; 4.14; 4.15; 4.17; 4.18; 4.19. M. On -sale wine licenses may be granted on or after August 1, 1975. Section 2. Effective Date. This ordinance shall take affect upon its passage and publication.
