HomeMy WebLinkAboutCity Council Ordinance 1975-07ORDINANCE NO. 75-7 CITY OF PLYMOUTH AN ORDINANCE RELATING TO THE POSSESSION AND COIISU14PTION OF ALCOHOLIC BEVERAGES BY MINORS, AMENDING CHAPTER V, SECTION 1.18 OF THE ORDINANCES OF THE CITY OF PLYMOUTH THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of City Code. Chapter V, Section 118 of the City Code is hereby amended as follows: "1.18. Possession and Consumption of Intoxicating and j Non -Intoxicating Liquors by a Minor. I (a) Definitions. (1) "Minor" when used herein shall mean any person who has not attained the age of eighteen (18) years. (11) "Non -intoxicating malt liquor" when used herein shall mean any malt liquor or beverage which contains not less than 1/2 of 1% and not more; than 3.2% of alcohol by weight. 1 (iii) "Guardian" when used herein shall mean any person who has been appointed or designated by a Court of record as the guardian of any minor. (iv) "Alcoholic beverage" when used herein I shall mean any malt liquor or beverage which con- j tains not less than 112 of 1% alcohol. ! (v) "Intoxicating liquor" when used herein j means ethyl alcohol, distilled, fermented, spiritous, vinous, and malt beverages containing In excess of 3.2% alcohol by weight. (b) Prohibitions. (1) It shall r..- unlawful for any minor to consume non -intoxicating malt liquor unless in the company of his parents or guardian. M1 Ordinance No. 75-7 Page 2 (ii) It shall be unlawful for any minor to have in his possession any non -intoxicating malt liquor, with intent to consume the same at a place other than household of his parent or guardian.', Possession of such non -intoxicating malt liquor at a place other than the household of his parents or guardian shall be prima facie evidence of intent to consume the same at a place other than the I household of his parent or guardian. (iii) It shall be unlawful for any person to induce a minor to purchase .>r procure non- . ; intoxicating malt liquor or for any person other than his or her parent or guardian to procure, 1 give to, sell to or purchase any non -intoxicating i malt liquor for any minor. (iv) It shall be unlawful for any minor to consume or possess any intoxicating liquor or to purchase, attempt to purchase or have another purchase for him any intoxicating liquor. (v) It shall be unlawful for any person to give to, sell to, procure or purchase intoxicating liquor for any minor or other person to whom the sale of intoxicating liquor is by law forbidden. (vi) It shall be unlawful for any person to misrepresent or misstate his age, or the age of any other person, for the purpose of inducing any licensee or the employee of any licensee, to sell, serve or deliver any alcoholic beverage to any minor. (c) Proof of Age. Proof of age for purposes of consuming, purchasing, or possessing an alcoholic beverage, the consumption, sale, or possession of which is regulated by age, may only be established Ordinance No. 75-7 Page 3 by a valid driver's license or a current non- i qualification certificate issued pursuant to Minnesotai. Statutes 1971, Section 171.07, and the sale of any j alcoholic beverage to any person not displaying such proof after being requested to prove his or her age .; by any licensee or employee of any licensee is `f unlawful." 7 Section 2. Effective Date. This ordinance shall take effect upon its passage and publication. '4 Adopted by the City Council this 21st day of April, 1975. ATTEST:
