ORDVWCE NO. 74-27
AN ORDINANCE AMENDING SECTION 11 OF CHAPTER V OF THE CITY
CODE RELATING TO CONDUCT IN PUBLIC PARKS
THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Amendment of City Code. Section it of Chapter V of
the City Code is hereby amended by adding the following thereto as
Section 11.01(k) and by deleting Section 11.04 and substituting the
following therefor:
"Section 11 - PARKS - REGULATION OF USES AND CONDUCT THEREIN.
11.01 Regulations
(k) Subject to the provisions of Section 11.05 of this
Chapter. no person shall remain in or on any public park, park-
way. beach, or drive when such park. parkway, beach, or drive
is closed.
11.04 Closing of Parks and Beaches.
(a) All public parks and beaches within the limits of the
City of Plymouth will close at 10:00 o'clock p.m. and will reopen
at 6:00 o'clock a.m. Groups. associations or organizations wish-
ing to meet in a park or beach area past 10:00 o'clock p.m. must
obtain a permit from the City Manager. The City Manager shall
grant the application if the use for which the permit issought
will not interfere with the health, safety, welfare and morals
of the general public and if the applicant meets all other conditions
as may be contained in the application form. The application form
may contain a requirement for an indemnity bond holding the City
harmless from liability of any kind or character and which bond
shall protect the City in use of property damage. The bond
shall be filed with the City Clerk.
(b) The Chief of Police may, upon his order, close any
public park, parkway. beach, or drive at any time, and for such
period as deemed necessary, in order to protect or restore order,
or terminate or prevent breaches of the peace and order of the
City. No person having been informed of such an order closing
any such area shall remain in the area longer than is necessary
to leave the closed area."
Section 2. Effective Date. This ordinance shall take effect upon
its passage and publication.
