HomeMy WebLinkAboutCity Council Ordinance 1973-16VILLAGE OF PLYMOUTH ORDINANCE NO. 73-16 AN ORDINANCE AMENDING CHAPTER V OF THE VILLAGE CODE RELATING TO THE REGULATION OF RECREATIO`L MOTOR VEHICLES THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DOES HEREBY ORDAIN ' AS FOLLOWS: Section 1. Ame,,dment of Village Code. Chapter V of the Village Code is hereby amended by ending the following as Section 13 thereof: "SECTION 13. RECREATIONAL MOTOR VEHICLES - REGULATION OF 13.01. Definition of Recreational Motor Vehicle. (a) A "Recreational Motor Vehicle" is hereby defined as any self-propelled vehicle and any vehicle drawn, pushed or otherwise propelled by a self- i propelled vehicle and designed for use for recreational purposes including but.not limited tomotorcycles. motor scooters, trait bikes. ' other all -terrain vehicles, hovercraft or any other motor vehicle licensed and used for recre- ational purposes. (b) Snowmobiies being the subject of regulation pursuant f to Section 7 of this Chapter are specifically ex- j cluded from the provisions of this section. Ii 13.02. Use of Recreational Motor Vehicles. It shall be unlawful for any person to operate a recreational motor vehicle within the limits of the Village of Plymouth, (1) On the private property of another without lawful authority or consent of the owner or occupant of such property. (2) On public sidewalks, walkways or trails provided or used for pedestrian travel. (3) On or across park lands, ice skating rinks whether on lakes or flooded, nor shall such vehicles park on such areas unless a permit to do so has been obtained from the Village of Plymouth or unless such areas have been specially designated for such use. (4) On any publicly owned lands and frozen waters, including but not limited to school grounds. playgrounds, recreation areas and golf courses unless a permit has been obtained from the proper public authorities or unless such areas have been specially designated for such use. i (5) At any place while under the influence of intoxicating liquor or narcotics or habit I forming drugs. (6) At a rate of speed greater than reasonable and proper under all the.surrounding circum- stances. (7) At any place in a careless, reckless or negligent manner so as to endanger the person or property of another or to cause injury or damage thereto. (8) In a manner so as to create a loud, unnecessary or unusual noise which disturbs, annoys or interferes with the peace and quiet of other persons. (9) In any cemetery. (10) In any planting or tree nursery in a manner which damages or destroys growing stock. 13.03. Penalties. The violation of any of the provisions of this section shall be deemed to be a petty mis- demeanor unless such violation constitutes a hazard or danger to life or property in which case such violation shall be deemed to be a misdemeanor."
