VILLAGE OF PLYMOUTH
AN ORDINANCE AMENDING PORTIONS OF SECTION 4
AND SECTION 19 OF THE ZONING ORDINANCE OF THE
VILLAGE OF PLYMOUTH RELATING TO CERTAIN DEFI-
NITIONS OF TERMS AND AFFECTING THE AUTHORITY
OF THE BOARD OF ZONING ADJUSTMENT
THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Amendment of Zoning Ordinance. Ordinance No. 68-8, the
Plymouth Village Zoning Ordinance, is hereby amended in the following partic-
ulars:
1.01. Section 4, Subdivision 2 of said Ordinance is amended by re-
pealing the definitions contained therein for the words "Basement,
Cellar, Grade, Sign and Story" and by substituting the following
therefor:
"Basement --That portion of a building between floor and ceiling
w ich is partly below grade, but so located that the verti-
cal distance from grade to the floor below is less than the
vertical distance from grade to ceiling. (See "Story")
Cellar --That portion of a building between floor and ceiling
wFich is wholly or partly below grade and so located that the
vertical distance from grade to the floor below is equal
to or greater than the vertical distance from grade to
ceiling. (See "Story")
Grade --The ground elevation established for the purpose of regu-
--"'rating the number of stories and the height of structures.
The grade shall be the average final elevatAon of the grading
adjacent to and within twenty (20) feet of the structure for
at least fifty (50) percent of the total perimeter of the
area around the structure.
Sign --Any billboard, notice, poster, display or other device
visible to and primarily intended to advertise and inform
or to attract attention, and shall include any structures
erected primarily for use in connection with the display of
any such device and all 'fighting or other attachments used
in connection therewith.
Story --That portion of a building included between the upper
surface of any floor and the upper surface of the floor next
above. If the finished floor level dire---tly above a basement
or unused under -floor space is more than six (6) feet above
grade as defined herein for more than fifty (50) percent of
the total perimeter or is more than twelve (12) feet above
grade as defined herein at any point, such basement or un-
used under -floor space shall be considered as a story."
1.02. Section 4, Subdivision 2 of the Zoning Ordinance is hereby amended'
by adding the following definitions thereto:
"Sign, Directional --A sign erected on private property for the
purpose o directing traffic to a specific location.
Sign.Temeorar --r sign erected or placed on private property for
a limited period of time including signs affixed or attached
to vehicles including trailers and capable of being readily
removed."
1.03. Section 19, Subdivision 2 of the Zoning. Ordinance is hereby amend-
ed by repealing nd deleting paragraph 1-b of said subdivision
and substituting the following therefor:
"Subdivision 2. Powers.
1. To consider applications for variances and modifications in
any of the provisions of this Ordinance relating to:
b. Sign regulations provided that no such variance may be
granted contrary to the requirements of the Minnesota
Outdoor Advertising Control Act and provided further that
no variances shall be granted to permit signs in districts
or locations where such signs are prohibited."
Section 2. Effective Date. This ordinance shall become effective upon
Its passage and publication.
Adopted by the Village Council of the Village of Plymouth this 21st day
of August, 1972.
