ORDINANCE NO. 71-19
AN ORDINANCE AMENDING THE VILLAGE CODE AND PROVIDING FOR THE
REGULATION OF USES OF VILLAGE PARKS AND CONDUCT THEREIN.
THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Amendment of Village Code.
Chapter V of the Village Code of the Village of Plymouth is
hereby amended by adding the following as Section 11 thereof:
"Section 11. PARKS -- REGULATION OF USES AND CONDUCT
THEREIN.
11.01. Park Regulations. With respect to all parks
and park land in the Village of Plymouth:
(a) No person shall willfully mark, deface or
disfigure, injure, tamper with, or displace or remove, any
building, bridge, table, bench, waste receptacle, fireplace,
railing, paving or paved material, waterline or other public
utility or part or appurtenance thereof, sign, notice or place -
card whether temporary or permanent, monument, stake, post or
other boundary marker, or other structure, equipment or park
property or park appurtenances whatsoever, either real or
personal.
(b) No person shall fail to cooperate in maintaining
rest rooms, wash rooms and other sanitation facilities in a
neat, orderly and sanitary condition. No person over the age
of five years shall use the rest rooms and washrooms designed
and designated for members of the opposite sex.
(c) No person shall throw, discharge, or otherwise
place or cauue to be placed in the water of any fountain, pond,
lake, stream, bay or other body of water in or adjacent to any
park or in any tributary, stream, storm sewer or drain flowing
into such water, any substance, matter or thing, liquid or
solid; nor shall any person bring in or dump, deposit or leave
any bottles, broken glass, ahses, paper boxes, cans, dirt,
rubbish, waste, garbage or refuse or any other trash, in any
park or portion thereof, or in any waters in or contiguous
to any park. All such refuse or trash shall be placed in the
proper receptables; where proper receptacles are no_ provided,
all such refuse or trash shall be carried away from the park
by the person responsible for its presence properly disposed
of elsewhere.
(d) No person shall picnic or lunch in any place
other than those designated for that purpose. Attendants shall
have authority to regulate activities in such area when necessary
to prevent congestion and to secure the maximum comfort and
convenience for all. Visitors shall comply with directions
given to achieve this end.
(e) No person shall use any portion of the picnic
areas or any of the buildings or structures therein for the
purpose of holding picnics to the unreasonable exclusion of
other persons, nor shall any person use such areas and facilities
for an unreasonable length of time if such facilities are crowded.
(f) No person shall leave a picnic area before the
fire has been completely extinguished or before all trash and
refuse have been placed in the receptacles provided. where no
receptacles have been provided, all trash and refuse shall be
carried away from the park area and shall be properly disposed
of elsewhere.
(g) No person shall within any park or parkway
expose or offer for sale, rent or hire any article or thing.
Excepted are those who have obtained a license to so operate
from the Village Manager.
(h) No person shall announce, advertise, or call
the public attention to any article or service for sale or
hire in any way.
(i) No person shall post, glue, tack or otherwise
post any sign, placard, advertisement, or inscription what-
soever in park lands, or on any public lands, highways or
roads adjacent to park lands.
(j) No person shall engage in golfing practice
with otter than light plastic hollow balls and then only at
areas designated for such practice.
11.02. Group Activity. No group, association, or
organization desiring to use park facilities for a particular
purpose such as but not limited to picnics, parties, or
theatrical or entertainment performances, shall do so without
first obtaining a permit for such use from the Village Manager.
The Village Manager shall grant the application if the use for
which the permit is sought will not interfere with the health,
safety, welfare and morals and use of the park by the general
public and if the applicant meets all other conditions as may
be contained in the application form. The application form
may contain a requirement for an indemnity bond holding the
Village harmless from liability of any kind or character and
which bond shall protect the Village in case of property
damage. The bond shall be filed with the Village Clerk.
11.03. Flowers Trees and Shrubs. Any person who
shall willfully an wit out authority cut, pluck, or otherwise
injure any flowers, shrubs, or trees growing in or around any
public park, or on other public grounds, shall be guilty of
a misdemeanor.
11.04. Curfew. All public parks and beaches within
the limits of the T=age of Plymouth will a at 10:00 o'clock
p.m. Groups, associations or organizations .._shing to meet in
a park or beach area past 10:00 o'clock p.m. must obtain a
permit from the Village Manager. The Village Manager shall
grant the application if the use for which the permit is
sought will not interfere with the health, safety, welfare
and morals of the general public and if the applicant meets
all other conditions as may be contained in the application

11.05. Night Parl�ing. No person shall be in,
remain in, or leave or park any vehicle in any park, parkway,
beach or drive between the hours of midnight and 6:00 o'clock
a.m. This section shall not apply to those who, without delay,
are traveling upon the established walks, paths, parkways, and
drives of the parks.
11.06. Hunting. No person shall rob, injure, or
destroy any bird or animal nest within the limits of any park,
nor shall any person aim or discharge any air gun, sling shot,
arrow ar other weapon, or throw any stone or other projectile
at any bird or animal within any park, nor in any manner
capture, kill or harm in any way any bird or animal therein.
11.07. Trapping. No person shall set, lay, pre-
pare or have in his possession any trap, snare, artificial
light, net, bird line, ferret or any contrivance whatever, for
the purpose of trapping, catching, taking or killing any bird
or animal within any park or parkway.
11.08. Firearms and Fireworks. No person shall
within the limits of any parl or par ay, fire or discharge
any cannon, fowling piece, pistol, revolver or firearm of
whatever description, or fire, explode or set off any squib,
cracker, firecracker, or any other thing containing powder
or other combustible or explosive material. Exhibitions of
fireworks given under the direction and authority of the
Village Council or its proper officers are excepted from the
operation of this Section.
11.09. Green�stri_ sem. Greenstrips shall be kept up,
if dedicated to ne gh o�o3 associations, by those associa-
tions. The obligations of such associations to maintain
greenstrips shall include but not be limited to the following:
cutting grass, picking up litter, pplanting trees, and other
such details as may Le prescribed by the Village Council.
11.10. Bridle Paths. All horses and riders will
ride only on designate ri a paths, with horses kept under
control at all times. No horse shall be allowed to roam free
in any park or bridle area and no horse shall be allowed in
the lakes or on the beaches.
11.11. Vehicles. No motorized vehicles or machines
of any kind or character, except those operated by and for the
Village of Plymouth or other competent governing authority,
shall drive on or across pai,k lands, the ice of skating rinks,
whether lakes or flooded, nor shall such vehicle or machine
park on these areas, without first obtaining a permit from the
Village Council or its designated officials, paying the fees
fixed from time to time and abiding by the rules, regulations,
and ordinances of the Village established to regulate such
activity.
11.12. Penalty. Any person, firm, group, associa-
tion, corporation or other organization violating the provi-
sions of this ordinance shall, upon conviction, be punished
for each separate conviction by a fine not to exceed $500 or
by imprisonment for a period not to exceed 90 days.
Section 2. Effective Date. This ordinance shall take effect
upon its passage and publication.
Adopted by the Village Council the 16th day of
August, 1971.
