HomeMy WebLinkAboutCity Council Ordinance 1971-14VILLAGE OF PLPIOUTH ORDINANCE #71-14 AN ORDINANCE AEh'DING SUBDIVISION 3 OF SECTIO!! 17 OF THE PLYMOUTH ZONING ORDINANCE RELATING TO THE HEIGHT OF BUILDINGS IN CERTAIN DISTRICTS THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of Ordinance. Ordinance No. 68-8 of the Village of Plymouth adopted May 13, 1968, known as the Plymouth Zoning Ordinance, is hereby amended by deleting paragraph l.d. of Subdivision 3, Section 17 and substituting the following therefor: Section 17. GENERAL REGULATIONS Subdivision 3. Additional Requirements. Exceptions and Modifications. 1. Height Regulations: 6 d. Height limitationsset forth in the R-4, B-1, B-2, B-3, B-4,;1-l•an._ I-2 Districts may be;increased to a greetor`beight parovided'the following conditions are met: (1) No increase in height limitation shall be allowed, except by Conditional Use Permit. (2) The building or portion thereof with increased height shall not be adjacent to nor closer than three hundred (300) feet to any lot in any R -O, R-1, R-2 or R-3 District. (3) Where an increase in the height limitation is allowed under this Subdivision, the building or portion thereof shall be set back from all side and rear lot lines an additional distance of one (1) foot for every one (1) foot that the building exceeds the height limitation of the District in which it is located. (4) The building or portion thereof with increased height shall be setback from yard lines an addi- tional distance of one (1) foot for every one (1) foot that it exceeds forty-five (45) feet. (5) A site plan of the proposed building shall be submitted along with the application for Conditional Use Permit. Such site plan shall show the location and extent of the proposed building, parking, loading, access drives, landscaping and any other improvements. Upon consideration by the Planning Comirission and subsequent approval by the Village Council said site plan shall be attached to and become a part of the Conditional Use Permit. Any substantial change to the site plan shall require a resub- mission to the Planning Commission and subsequent approval by the Village Council. (6) The provision of subparagraph (2), (3) and (4) above, may be waived by the Village Council, in whole or in part, upon a finding that such a waiver would not have a deleterious effect upon surrounding properties. Section 2. Effective Date. This ordinance shall take effect upon its passage and publication. Adopted by the Village Council of the Village of Plymouth this 28th day of June, 1971. Mayor
