AN ORDINANCE AMENDING CHAP, TER. VII
SECTION 8.05 OF THE'VZLL&GE CODE
RELATING TO PARTICIPATION BY THE
VILLAGE IN IMPROVEMENTS REQUIRED
IN SUBDIVISIONS
THE VILLAGE COUNCIL SOF THE VILLAGE OF PLYMOUTH DO HEREBY #RDAIN AS
FOLLOWS:
Section 1. Amendment of Village Code. Section 8.05 of Chapter VII
of the Village Code is hereby amended by deleting all of said Section
8.05 and substituting the following therefor:
"8.05. Participation of Village.
(a) Residential Developments. The owner and subdivider,
engaged in the developmeat of lands and properties which are
zoned as R -O, R-1, R-2, R-3 or R-4, in the installation of
sanitary sewers, water systems and storm severs required by
this section, may request Village participation In,the pay—
ment of the costa of such installations and in such event
such owner and subdivider shall comply with the fallowing.
requirements:
(1) Such owner and subdivider shall make a cash
deposit with the Village Treasurer in an
amount equal to twenty-five per cent (252)
of the estimated cost of installing such
improvements as such costs are determined
by the Village Engineer. Such deposit shall
be applied to the costs of such installations.
(2) All such services shall be planned and design-
ed by the Village Engineer and shall be in-
stalled by the Village. The charges of the
Village Engineer in connection with such pro-
jects shall be included in the estimated costs
referred to in (1) above.
(3) Upon completion of such installations, the
Village shall cause to be assessed against the
lots in the subdivision the remaining seventy-
five per cent (75Z) of the costs of such In-
stallations. Such assessments shall be over a
period of five (5) years together with interest
thereon.
(4) At the time of the application for a building
permit with respect to any of the lots in the
subdivision, the applicant shall pay to the
Village Treasurer a sum equivalent to one
hundred (100X) of the principal balance of
such assessment remaining unpaid on said lot
together with accrued interest.
(b) C rcial Industrial lleyslopments. The owner and
subdivider, engaged in the development of lands and properties
which are zoned B-1, B-2, B-3, B-4,;, 1--I and I-2, in the in-
stallations of sanitary sewers, water bystems, storm sewers,
streets and curb and gutters as such"map be required by this
section, may request Village participation in the payment of
the costs of such installations and in such event such owner
and subdivider shall comply with the following requirements: i
(1) su,n owner and subdivit,er shall make a cash
deposit with the Village Treasurer in an amount
equal to twenty-five.per cent (25X) of the est-
imated cost of installing such Improvements as
such costs are determined by the Village Engin-
eer. Such deposit shall be applied to the costs
of such installations.
(2) All such services shall be planned and designed
by the Village Engineer and shall be installed
by the Village. The charges of the Village
Engineer in connection with such projects shall
be included in the estimated costs referred to
in (1) above.
(3) Upon completion of such installations, the
Village shall cause to be assessed against the
tracts or lots within the development the re-
maining seventy-five per cent (752) of the
costs of such Installations. gtch assessor.=nts
shall, be levied and spread,iogether with int-
erest :thereon, over a period of ten (10) years
with respect.to,the costs of installation of
sanitary sewer, storm sewer and crater systems
and over a,period of five (5) years with res-
pect to the costs of installation of streets
and curb and gutter.
(4) At the time of the application for a building
permit with respect to any of the tracts or
lots within the development, the applicant
shall pay.to the Village Treasurer a sum equi-
valent to one hundred per cent (100X) of the
principal balance of such assessment remaining
unpaid on such tracts"or lots together with
accrued interest.
(c) The owner and subdivider, in the installation of
sanitary sewers, water systems storm sewers, streets and curbs
and gutters required by this section, may elect to provide such
services to the subdivision at his own expense and without
Village participation in the expense thereof. In such event
the owner and subdivider may retain his ot,n engineer and con-
tractor to plan, design and install such services. Such planning,
designing and installation shall be subject to review and in-
spection by the Village Engineer. In such event, the estimated
cost of such improvements including the charges of the Village
Engineer for supervisi#ion and inspection, shall be included in
the subdivider's contract with the Village and the appropriate
security in the form of cash or bond shall be deposited with
the Village..
Section 2. Effective Date. This ordinance shall became effective

upon its passage and publication.
