HomeMy WebLinkAboutCity Council Ordinance 1969-21VILLAGE OF PLYMOUTH ORDINANCE NO, 69-21 AN ORDINANCE AMENDING CHAPTER VIII., SECTION 9, OF THE VILLAGE CODE RELATING TO RULES, REGULATIONS AND RATES FOR WATER SERVICE AND ESTABLISHING A NATER DEPARTMENT THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DO HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of Village Code. Chapter VIII., Section 9 of the Village Code is hereby amended by deleting the whole of said Section 9 and substituting the following therefor: "SECTION 9. RULES AND REGULATIONS FOR WATER SERVICE 9.01. Administration. There is hereby estdolisbed in the Village of Ply- mouth a water department which shall be under the direct regulation and control of the Villa$e Council. The Council shall appoint a Superintendent and such other persons as 'shall be necessary to perform duties in such water department either in connection with other Village employment or as part-time employment. Such persona shall work under the direct super- vision of the Clerk -Administrator. 9.02. The Superintendent shall see that all rules and regulations per - taming �,o the water system, the tapping of some by licensed plumbers, and the use of water be complied with in all respects, to see that no persons shall open any hydrant for any purpose whatsoever without his persission, except members of the Fire Department. 9.03. Bond Required. No person, firm, or corporation shall engage in the business of installing water service unless he has first posted a bond in i the amount of $1,000 and has a master plumber's license as required under the vtate Plumbil Code. j c 9.04. A. Patmit ! uired. No person, firm or corporation shall install, alter or extend any individual municipal water system in the municipality without first obtaining a permit therefore from the Water Department for the specific installation, alteration or extension. A. Permit Fee and Application - Amount - Terms - Forms. At the i; time of applying for said permit, the applicant shall pay a service charge as indicated in Section S. Such permits shall be valid for a period of six months from date of issue. Applications for permits shall be made in i writing upon printed forms furnished by the Village, and shall contain the new of the owner, an account number, and a legal description of the property. lot, block and addition, name of the street upon which the property fronts and the official street number assigned to the premises as shown by the i records of the Village of Plymouth, and the signature of the applicant �. agreeing to conform to the rules and regulations of the Water Department i that may be established by the Village as conditions for the use of water. ai C. When service connections have been installed, application for water service may be made either by the owner or his duly authorized agent. 9.05. Service Charges. A. Water Connection Permit. A permit must be obtained to connect to existing water service leads at the curb box. The fee for a single family residential 5/8" x 3/6" meter shall be $80.00. No permit shall be issued except to a licensed and bonded plumber. (� B. Large Sites. For larger connections, the t to be charged •f shall be as follows: The fee for each permit shall be $25.00 plus the cost ii } of the mater in respect to its size. The meter shall remain to be the �F property of the Village. C. Ser*ica Connection. If a service connection is required for a lot that is presently unserviced, the connection to the water main, corpora- tion stop, curb stop and box and _pipiing shall be placed by a licensed plumber. A street excavating permit shall be required. 1 D. Turn. On Water. For turning on water where service has been turned i off for non-payment of witlr bill, failure to repair a leak, discontinuance of { service or any other cause, a service charge of $10.00 will be made. E. Ad3ust Curb Boxes. For raising or lowering stop box tops to i correspond with ground level change made by property owner. a charge of i i $15.00 will be made. I 9.06. Inspection Requirements. A. No part of the system shall be covered until it has been inspected and accepted by an Inspector of the Water Department. It shall be the i responsibility of the applicant for the permit to notify the Water Department that the job is ready for inspection or re -inspection, and it shall be the duty of the Inspector to make the indicated inspection within eight working hours after such notice has been given. It shall be the duty of the owner or occupant of the prcperty to give the Inspector free access to the prop- s; jE erty at reasonable times for the purpose of making+ such inspection. i B. If upon inspection the Inspector discovers that any part of the system is not constructed in accordance with the minimum standards pro- vided in this Rection, he shall give the applicant written notification describing, the defects. The applicant shall pay an additional fee of $5.00 for each re -inspection that is necessary. The applicant shall be responsible for the correction or elimination of all defects, and no system shall be 'r placed or replaced in service until all defects have been corrected or i� eliminated. 9.07. Testing Water Service Lines - Single Family Residents Excluded. A. Pressure During Tests. After the pipe has been laid and par- tially backfilled as specified, all Healy laid pipe, or any valved section of it shall, unless otherwise specified, be subjected to hydrostatic or air pressure of 150 lbs. per square inch. Theitest must be conducted i under the supervision of the Inspector and with Lis approval. B. Duration of Pressure Test. The duration of each pressure test i j shall be at least 30 minutes. C. Procedure. Each valved section of pipe shall be slowly filled with water from a safe source if a hydrostatic test is used, and the speci- fied test pressure, measured at the lowest point of elevation, shall be applied by means of a pump cnnnectAd-to the pipe in a satisfactory manner. The pump, pipe connection, gauges and all necessary apparatus shall be furnished by the Contractor. Gauges and measuring devices must meet with the approval of the Water Department and the necessary pipe taps made as directed. D. Expelling Air Before Test. Before applying the specified test pressure, all air shall be expelled from the pipe. To accomplish this, taps shall be made, if necessary, at points at highest elevation and a"erward tightly plugged. E. Examination Under Pressure. All exposes pipes, fittinc valves, hydrants and joints will be carefully examined during the open trench test. +i Any crack or deferLive rA,pes, fittings, valves or hydrants discovered in consequence of .he pressure test shall be removed and replaced by the Contractor Witt sound material in the manner Provided and the test shall s be repeated until satisfacotry to the duly authorized agent. F. Pitrmissable Leakage. A drop in pressure over the 30 minute test period exc;_eding three pou.ids shall be cause for rejection of the project. All leaks shall be corrected and the test repeated until the pressure drop is withiv the three pound limit. 4.08. C:rnductivity, Conductivity shall be provided thro,xghout the water system by use of coy%per straps or approved conductive gaskets with copper inserts. All fit;:ings shall be mechanical joint with copper straps. Lead tipped gaskets will not he approved. B. Copper jumper straps between sections of pipe shall be not less than 1/16" x 3/4" strap bolted to shop welded pipe straps of the same size. z Bolts shall be 5/16" diameter bronze. For all locations where shop welded ij straps are not available, field welds shall be made using the Badweld method y{ ji with size 32 cartridge. Each field weld shall be properly made after filing the surface of the pipe to a clean bare metal over'the entire area of the I weld. Straps bolted to mechanical joint fittings shall be not less than 1/16" x 1�". All straps shall be securely fastened and backfill placed so jas to not damage the conductivity. { C. Conductivity test shall be performed on all mains after they 1 have been pressure tested and are full of water at normal operating pressure. r A direct current of 350 amps at 30 volts shall be passed through the line Y for four minutes. Current flow shall be measured continuously cn a suit- i 4 able ammeter and shall remain steady without interruption or excessive r. fluctuation throughout the period. At the end of the four minute period, j the current shall be raised to 400 amps for one minute without fluctuation. iy Insufficient current or wide fluctuations of ammeter needle shall be evid- r ,r ence of defective conductivity which shall be isolated, corrected and retested. Acceptable equipment for the test shall be arc welding machines with adequate sized cables to carry the tese.t current without voltage drop or overheating. Conductivity test shallbe carried out in the presence of an Inspector of the Water Department. {1 ff y 9.09. Time for Connection. All properties consuming water for domestic purposes must either connect to the municipal water system within two years after such service becomes available, or annually submit a certified water test made by a testing laboratory approved by the Village Health Officer. This test must *holo that the water is potable according to the standards of the Minnesota Department of Health and that there is no evidence of re- circulated sewage. Maximum chemical and bacterialogical criteria shall be as follows: 1 Nitrates: Less than 1.0 mg/liter of nitrate nitrogen. Surfactants: No evidence of surfactant conter.c utilizing a test procedure designed to show the presenrw of in concentration of 0.05 mg/liter or greater. 'i Coliform: None If, from any cause, the plumler laying the service pipe shall fail to have ;i the connection made at the time specified in his application, notice must be given to the Nater Department fixing another day on which he wishes to i make the connection. The notice must be given at least one day previous to the excavation for laying of the service pipe, and the connection must be made before 4:30 P.M. except in special cases, and then the work shall be done only upon a written order from the Water Department. ;i 9.10. Property Assessments. A. Fee for permit for water main tapping shall be paid for each �f �j connection in the amount specified in Section 9.05. Ei �s B. No permit shall be issued to tap or connect with any water main j of the Runic psxit3r either directly or indirectly from any lot or tract of I' land unless the Finance Department shall have certified: r: 1. That such lot or trace of land, or portion of lot or tract, to i� be served by such connection or tap has been assesaed for the cost of ti ji construction of the water main with which the ,connection is made, or it 1. If no assessment has been levied for such construction cost, { that proceedings for levying such assessment have been or will be commenced in due course, or 3. ' Where service is for less than a quarterly period, this charge will be pro- rated un a monthly basis. B. When water i,: d—ired for constructior, purposes or other temporary uses, the owner shall make a?plication in the regular way and on the regular farm to be furnished by the municipality. C. Water bills shall be mailed to the customers and shall specify the water consumed and the charge in accordance with the foregoing rates. Payments shall be due and payable upon full receipt of bill. D. Should it be found that water not metered is used through a fire connection 'f if i for any purpose other than the extinguishing of fire upon the premises, the owner and occupant will be notified, and if such improper conditions are not s corrected within ten (1-0) days, the water will be shut off until proper ad- justments are made, and the owner shall be subject to the penalties as pro- } vided in this ordinance. i Regular inspections shall be made of all fire service connections with all piping, fire gates, and other attached appurtenances. Employees of the Water Department shall have access to the premises for such inspection and shall keep a record of all inspections made. E. Rates due and payable to the Municipality by each water use; located beyond the territorial boundaries of the idunicipality shall be on the same basis as specified in sub -paragraphs A, H. C and D above plus 50% in each case. 9,13. Water Availability Charge. A water availability charge at the rate of $3.00 per quarter is due and payable by the owner of each lot or parcel of land which has had municipal water service available for a period of two and one half (21) years or more if such lot or parcel is not connected to the municipal water system„ provided, this charge is not due if there is no building or other structure on such lot or parcel, 9.14. Delinquent Water Accounts. All charges of water shall be due on the date specified by the Finance Department for,the respective account, and shall be delinquent fifteen days thereafter. It shall be the duty of the Finance Department to endeavor to promptly collect delinquent accounts, and in all cases where satisfactory arrangements for payment have not then been made, Instructions shall be given to discontinue service by shutting off the water at the stop box. All delinquent accounts shall be certified to the Village Clerk -Administrator who shall prepare an assessment roll each year providing for assessment of the delinquent amounts against the respective properties served. This assessment roll shall be delivered to the Village Council for adoption on or before October 1 of each year, Such action may be optional .or subsequent to taking legal action to collect delinquent accounts. 9.15. Discontinuance of Service for Ordinance ViolaH ons. Watar Service may be shun off at any stop box connection whenever: A. The owner or occupant of the premises served, or any person work- ing on any pipes or equipment thereon which are connected with the Municipal Water Supply System has intentionally violated any of the requirements of the ordinances of the municipality relative to the Water Supply S)stem, or connec- tions therewith. B. The owner or occupant of the premises served causes any of the provisions of this Code to be violated. C. Any charge for water, service, meter, or any other financial i? obligations imposed on the present or former owner or occupant of the premises served, by the provisions of this Code, is unpaid. D. Fraud or misrepresentation by the owner or occupant in connection with an application for service. 9.16. Discontinuance of Service Where Share of Cost of Construction has not Been Paid, Water service shall be shut off at the stop box connection when it is determined that a sum equal to the portion of the cost of constructing o mains and laterals attributable to the parcel or property as determined fi �E by assessment proceedings or pursuant to the provisions of Section 9.10, y Subd. C has not been paid or is not in the process of being paid in regular ? installments. 9.17, Deficiency of .Water and Shut:tirg Off Water. l A. The municipality shall not be liable for any deficiency or failure in the supply of warer to consumers, whether occasioned by shutting the dil water off for the purpose of making repairs or connections, or from any other } ewre whatever. In case of fire, or alarm of fire, water may be shut off `E ,f to insure a supply for fire fighting; or in making repairs or construction t, of new works, water may be shut off at any time and kept shut off so long as Mnecessary. l !� S. Turning 0n Water. No person, except an authorize' Village employee, ti shall turn on any water supply at the stop box without a permit frrnn the 'i Water Department. No permit will be issued unless the house number, an given by the Water Department, is prominently displayed, and no such permit shall be given anyone but a licensed and bonded plumber. The Village reserves Ij the right to turn off any water supply if said number is not displayed after a written notice has been sent to the owner as appearing on its books, C, Supply From One Service, No more than one house or building shall �r be supplied from one service connection except by special permission of the i; ,I Water Department. Whenever two or more parties are supplied from one pipe, c connecting with the distribution main, each building or part of building must have a separate stop boxanda separate meter. D. Tapping of Mains Prohibited. No person except authorized persons or employees of the Village shall tap any distributing main or pipe of the Municipal Water System, or insert stop -cocks or ferrules therein. E. Repair of Leaks. It shall be the responsibility of the consumer or owner to maintain the service pipe from the curb box into the house or i building. In case of failure upon the part of any consumer or owner to repair any leak occuring in his service pipe within twenty-four hours after verbal or written notice has been given the owner or occupant of the premises, ! the water will be shut off and will. not be turned on until the sum of $10.00 Pas been paid. When the waste of water is great, or when damage is likely to result from the leak, the water will be turned off if the repair is not proceeded with immediately upon the giving of such notice. 9.18, Abandoned Services; Penalties. A. All service installations connected to the water system, that have been abandoned or for any reason have become useless for further service, shall be disconnected at the main by the Village, and all pipe and appurten- ances removed shall be the property of the Village. When new buildings are erected on the site of old ones, and it is desired to increase or change the old water service, no connections with the mains shall be given until all the old service shall have been removed and the main plugged. If any contractor, workman or employee upon such bu'_Aing shall cause or allow any service pipe to be hamered together at tb�t ends to stop the flow of water, or to save expense in removing such pipe from the main, the owner of such building, such workman and contractor shall, upon conviction thereof, be subject to the penalties as set forth in said ordinance, and shall. remove said service pipe from the main. If he shall fail to do so on twent7-four hours' notice, he shall be obligated to pay the Village the cost incurred by it for such removal. B. Service Pipes. Every service pipe must be laid in such manner as to prevent rupture by settlement. The service pipe must be placed not less than six feet below the surface and in all cases so arranged as to prevent rupture by freezing. Service pipes must extend from the curb box to the inside of me building; I ;F or if not taken into a building then to the hydrant or other fixtures which !i it is intended to supply. A shut-off or other stop -cock with waste valve, of the size and strength required, shall be placed close to the inside wall of the building, well protected from freezing. Copper tubing shall be kept to a minimum without a joint used for a ser%ice up to ion feet in length. All joints shall be left uncovered until inspected. All services over two inches shall. be cast iron. Connections with the mains for residential supply shall be at least 3114 of an inch except lines in excess of loft feet shall i be not less than one inch. 9.19. Water deters. ;i A. Water Miter Required. Except for extinguishment of fires, no person except authorized Village employees shall use water from the water supply system of the Village or permit water to be drawn therefrom, unless i the same he metered by passing through a meter supplied or approved by the Vill-ige. No person shall connect, disconnect, take apart, or in any manner change, or cause to be changed, or interfere with any such meter or the action thereof, unless authorized by the Village. B. Permit for Temporary Service Connection. A permit fee of $15.00 plus the required meter deposit shall be made to the Water Department. Said deposit shall be returned upon satisfactory return of meter. C. Maintenance ReVair and Replacement. The Village shall maintain and repair or replace all meters when rendered unserviceable through ordinary wear and tear. However, where replacement, repair or adjustment of any meter is rendered necessary by the act, neglect or carelessness of the owner or occupant of any premises, any expense caused by the Water Department thereby shall be charged against and collected from the owner or occupant of the premises. Water service may be discontinued until the cause is corrected; and the charge collected. D. Complaint. 1. Whenn a consumer mares a complaint that the bill for any past service period has been excessive, the Water Department shall upon written request have such meter re -read, if the consumer remains dissatisfied and desires that the meter he tested, said consumer shall then make a deposit with the Finance Department as prescribed below, and the Village shall test the meter. The consumer shall, G if he so desires, be present when such test is made. 2. In case a test should show an error of over five percent of the water consumed in favor of the Water Department the deposit will be refunded to the consumer; and a correctly registered meter will be installed with the bill adjusted accordingly. Such adjustment shall not extend back more than one service period p?us one month from the date of the written request. The minimum charge shall :lot be affected. 3. In case the test shows an accurate measurement of water or irror in favor of the consumer, the amount deposited shall be retained by the Water Department to cover part of the-xpense of making such test. Before making a test of any meter, the person requesting such test shall, at the time of filing his request with the Water Department, make a deposit with the Finance Department of the amount charged for such test, sub!ect to the conditions stated above, which charges are as follows: 4. The following shall be applicable to deposits made: For testing 5/8" to 2" meters . . . . . . . . . $15.C!0 For testing 3""meters . . . . . . . . . . . . . $50.00 For testing 4" meters . . . . . . . . . . . . . $50.00 For testing 6" meters . . . . . . . . . . . . .$100.00 E. Village Prp2artx. All water meters shall be and remain the prop- erty of the Village and may be removed or replaced or changed as to size and type by the Water Department whenever deemed necessary. F. Access to Read Meters. Village employees delegated for that pur- pose shall have free access at reasonable hours of the day to all parte of every building and premises connected with the Municipal Water Supply System i for reading of meiers and inspections. The Village shall be authorized to make adjustments in water charges where in their opinion the amount billed is erroneous due to meter deficiency or other mistake, i; 9,20, Water Meter Setting. All water meters hereafter installed shall be ii in accordance with the following rules: A. The service pipe from the water main to the meter, when the same enters the building, shall be brought through the floor to a vertical posi- t tion. The stop and waste valve shall be installed about 12 inches from the s floor. t B. The meter shall be located so that the bottom is from six to ; twelve Inches above the fin#dhed floor line. The meter shall be set not s more than 12 inches measured horizontally from the inside line of the base- ment wall, unless an alternate method is approved by the Water Department. A suitable bracket to support the meter in a proper vertical position and to prevent noise from vibration shall be provided. C. All meter installations shall have a stop and waste valve on the street side of the meter. In no case shall there be more than twelve inches of pipe exposed between the point of entrance through the basement floor add the stop and waste. A stop add waste valve shall also be installed on the house side of the meter. D. The meters shall so be installed so as not to hinder reading and maintenance of same. Meter tting devices for 5/8", 3/4" and 1" meters shall be of copper pipe or tubing from the terminus of the service pipe up to and including the house side stop and waste valve. 9.21. Use of Dire Hydrants. No person other than an employee of the Water Department or the Dire Department or an employee of the Street Department who is engaged in sprinkling or washing the public streets or flushing sewers shall operate fire hydrants or interfere in any way with the Munict- „ pal Water System without first obtaining authority to do so from the Village. 9.22. Private Water Supplies. No water pipe of the Municipal Water Supply i �f System shall be connected with any pump, well or tank that is connected with any other source of water supply and when such are found, the Water Department shall notify the owner to disconnect the same, and if not done immediately, the water supply shall be turned off forthwith. Before any new connection to the Municipal System is permitted, the Water Department shall ascertain that no cross -connection will exist when the new connection is made. 9.23. Use Confined to Premises. No person -shall permit water from the Municipal Water Supply System to be used for any purpose except upon his own premises, 9.24. Connectious Be)rond Municipal Boundaries. In cases where water mains of the Village have been or shall be extended to or constructed in any road, w. street, alley or public highway adjacent to or -outside the corporate limits of the Village, the Clerk -Administrator, with the approval of the Village Engineer, is hereby authorized to issue permits to t'he owners or occupants of properties adjacent to, or accessible to, such water mains to tap and make proper water service pipe connections with such water mains of the Village in conformity with and subject to all the terms, conditions and provisions of the ordinances of the Village relating try the tarping of the municipal water mains and making water service pipe connections therewith, and to furnish and supply water from the water works system of the Village so srich owners and occupants of properties adjacent or accessible to such water mains of the Village through and by means of goner meters duly irs�alled. Water service rendered to such persons shall be subject to all provisions of this ordinance, and persons accepting; such service shall thereby agree to be bound and obligated by said ordinance. 9.25. Restricted Hours for S�tinklinE. Whenever the Council shall determine that a shortage of water supply threatens the Village, it may by Resolution i I, limit the times and hours during which water may be used from the Municipal Water Supply System for lawn and garden sprinkling, irrig- - sr washing, j air conditioning or other uses specified therein. Notice of such resolution shall be given in such manner as the Council may determine including, but J not limited to, newspaper articles, radio and television broadcast, etc. Two days after such notice, any water customer who shall cause or permit water f to be used in violation of the provisions of said Resolution shAll be given ij i a warning as to auah violation and there after upon successive violations shall be charged $5.00 for each day of such violation, which charge shall be added to his next water bill. Continued violation after such warnings shall bP ce•ise for discontinuance of water service." Section 2. Effective Date. This ordinance shall take effect upon its passage and publication.
