HomeMy WebLinkAboutCity Council Ordinance 1968-18VILLAGE OF PLYMOUTH ORDINANCE NO. 68-18 AN ORDINANCE RELATING TO BASIC IMPROVEMENTS REQUIRED IN SUBDIVISIONS, REPEALING SECTION 8 OF CHAPTER VII OF THE VILLAGE CODE AND SUB- STITUTING THE PROVISIONS OF THIS ORDINANCE THEREFOR THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DO HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of Village Code. Section 8 of Chapter VII of the Village Code is hereby deleted and the following sub- stituted therefor: "Section 8. BASIC IMPROoYB10;NTS REQUIRED. 8.01. It is hereby declared to be the policy of the Village to proceed as soon as practicable, after approval of the proposed plat, with tLe installation of all of the following improvements within the subdivision: (a) Sanitary sewage disposal (b) Street grading and paving (c) Concrete curb and gutter (d) Boulevard sodding (e) Drainage (f) Water 8.02. The installation of the above improvements subject to the provisions of Sections 8.04 and 8.05 below shall be under the control and supervision of the Village Engineer who shall specify the manner in which such installations shall be made. 8.03. No final plat shall be approved by the Village Council unless the owner or subdivider shall have placed the installed survey monuments of a perma- nent character at all points as shown on the final plat as required by the Village Engineer and the Hennepin County Surveyor. All United States, state, county, or other official bench marks, monuments or triangu- lation stations in or adjacent to the property shall be preserved in precise position. 8.04. No final plat shall be approved by the Council unless the owner or subdivider shall have complied with the following requirements: (a) Sanitary Sewer. Sanitary sewer mains and service connections stubbed in to the property line shall be installed to serve all lots in the sub- division when the location of such plat is within an area of the Village which is either being assessed i. for sanitary sewer service, or within which contracts " for such service have been awarded. The Council, i { i in its discretion, may waive the application of this i? portion of the ordinance upon a showing that to f. !i require the installation of such sanitary sewer mains i; within the subdivision would not be feasible with j regard to the extension of existing trunk and �f interceptor mains to service the subdivision or that 4{ the particular locations or unusual circumstances i' i of the proposed plat would cause undue hardship to ((� either the owner or subdivider or the Village. i( (b) Streets. The owner and subdivider shall, at t his own expense, provide and install streets that are graded and paved in accordance with specifications provided by the Village Engineer. Provided, however, that when sanitary sewer mains are not to be installed within the subdivision, the Council, in its discretion, may waive the requirement that such streets be paved. In the event such waiver is granted, the owner or subdivider shall deposit with the Village a sum of -2- money equivalent to the Engineer's estimated cost of such paving. (c) Curb and Gutter. The owner and subdivider shall, at his own expense, provide and install surmountable concrete curb and gutter in those subdivisions where sanitary sewer and paved streets are required. In the event that concrete curb and gutter are not required, the owner or subdivider shall deposit with the Village a sum of money equivalent to the Engineer's estimated cost of such concrete curb and gutter, (d) Boulevard Sodding. The owner and subdivider shall, at his own expense sod all boulevard strips in those subdivisions where concrete curb and gutter is required. In the event such sodding is not required, the owner or subdivider shall deposit with the Village a sum of money equivalent to the Engineer's estimated cost of such boulevard sodding. (e) Storm Sewers. A system of drainage that will adequately take care of the water run-off within the subdivision shall be provided. In the event it is feasible to connect to existing storm sewer systems, storm sewer mains within the subdivision shall be installed. (f) Water, Water mains and service connections stubbed in to the property line shall be installed to serve all lots in the subdivision when the location of such plat is within an area of the Village which is either being assessed for waterserviceor within ����,, which contracts for such service if been awarded. The Council, in its discretion, may waive the application of this portion of the ordinance upon a showing that to require the installation of such -3- water mains within the subdivision would not be feasible with regard to the extension of existing trunk mains to service the subdivision or that the particular locations or unusual circumstances of the proposed plat would cause undue hardship to either the owner or subdivider or the Village. (g) Escrow of Required Deposits. All sums deposited with the Village in accordance with (b), (c), and (d) above shall be kept in separate funds which funds shall be encumbered and earmarked for the later construction of the particular improvements within the particular subdivision. provided, however, that the deposits for concrete curb and gutter and boulevard sodding may be merged into a single fund. Such funds may be invested by the Village and interest earned on such investment shall accrue and be added to the appropriate fund. 8.05. participation of Village. (a) The owner and subdivider, in the installation of sanitary sewers, water systems and storm sewers required by this section, may request Village participation in the payment of the costs of such installations and in such event such owner and subdivider shall comply with the following requirements:'. (1) Such owner and subdivid,_ shall make a cash deposit with the Village Treasurer in an amount equal to twenty- five per cent (25%) of the estimated cost of installing such improvements as determined by the V411age Engineer. Such deposit shall be applied to the costs of such installations. (2) All such services shall be planned and J designed by the Village Engineer and !j shall be installed by the Village. The charges of the Village Engineer in connection with such projects shall be included in the estimated costs referred to in (1) above. { i i 1 -4- (3) Opon completion of such installations, the Village shall cause to be assessed against the lots in the subdivision the remaining seventy-five per cent (75%) of the costs of such installations. Such assessments shall be over a period of five (5) years together witlr interest thereon. (4) At the time of the application for a building permit with respect to any of the lots in the subdivision, the applicant shall pav to the Village Treasurer a sum equivalent to one hundred twenty-five per cent (1250 of the principal balance of such assessment remaining, unpaid on said lot together with accrued interest. Pro- vided, hm7ever, that the total amount thus collected by the Village shall not excec3 one hundred per cent (100%)exclusive of interest of the total of the assessment for such improve- ments levied against the entire subdivision. (b) The owner and subdivider, in the installation of sanitary sewers, water systems .Ind storm sewers required by this section, may elect to provide such services to the subdivision at his own expense and without Village partici- pation in the expense thereof. In such event the owner and subdivider may retain his own engineer and contractor to plan, design and install such services. Such planning, de- signing and installation shall be subject to review and in- spection by the Village Engineer. In such event, the estimated cost of such improvements including the charges of the Village Engineer for supervision and inspection, shall be included in the subdivider's contract with the Village and the appropriate security in the form of cash or bond shall be deposited with the Village. 8.06. Subdivision Contract. In order to effectuate the pro- visions of Sections 8.04 and 8.05 above, the owner and sub- divider shall enter into a contract with the Village pr,)viding for the installation of the required improvements. Such contract shall provide, among other things, for security to the Village in the -5- form of a surety bond, or cash in lieu thereof, in such amount as the Village Engineer shall deem to be adequate to insure the satisfactory completion of such improvements." Section 2. Effective Date. This ordinance shall be effective upon its passage and publication. Adopted by the Village Council the 14th day of October , 1968. _g_ VILLAGE OF PLYMOUTH ORDINANCE NO. 68-18 AN ORDINANCE REZONING INTO TIS R-1 CLASSIFICATION A PORTION OF SECTIONS 34 AND 35, TOWNSHIP 118, RANGE: 22 THE VILLAGE COUNCIL, OF THE VILLAGE OF PLYMOUTH DO F F:R?BY ORDAIN AS FOLLOWS: Section 1. Amendment of Ordinance. Ordinance No. 68-8, the Plymouth Zoning Ordinance, adopted May 13, 1968, is hereby amended by changing the classification on the Village of Plymouth Zoning Map from R-0 District to R-1 District with respect to the following described property: That part of the West 60 acres of the South j of the Northwest i of Section 35, Township 118 North, Range 22 West of the 5th Principal Meridian lying West of a line described as follows: Commencing at a point on the North line of Southwest I a distance of 1040 feet East from the Northwest corner thereof; thence Southwesterly at an angle of 720 301 with said North line a distance of 837 feet; thence along a line deflecting to the left 190 30' a distance of 300 feet; thence along a line deflecting to the right 190 30' to its intersection with the South line of the Southwest j of the Northwest I and there terminating. Also That part of the Southeast I of the Northeast I of Section 34, Township 118 North, Range 22 West of the 5th Principal Meridian; lying Easterly of the following described line: Commencing at a point on the South line of said Southeast I of the Northeast J, a distance of 33 feet West of the Southeast corner thereof; thence on an assumed bearing of North, parallel with the Fast line thereof, a distance of 18 feet; thence along a tangy gential curve to the left, having a radius of 212 feet and central angle of 440 201, an arc distance of 164.04 feet to a point of tangency; thence N 440 20' W a distance of 100 feet; thence along a tangential curve to the right, having a radius of 276 feet and central angle of 320 121, an are distance of 335 feet; thence
