HomeMy WebLinkAboutCity Council Ordinance 1967-21VILLAGE OF PLYMOUTH ORDINANCE NO. 67-541 AN ORDINANCE RELATING TO THE USE OF FIREARMS, AIR RIFLES, PELLET GUNS AND OTHER WEAPONS WITHIN THE VILLAGE OF PLYMOUTH AND AMENDING CHAPTER V. SECTION 4 OF THE ORDINANCE CODE THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DO HEREBY ORDAIN AS FOLLOWS: Section 1. Amendment of Ordinance Code. Chapter V, Section 4 of the Ordinance CoUe of the age o ymouth is hereby amended to read as follows: "Section 4. FIREARMS. 4.01. DISCHARGE OF FIREARMS. No person shall abootor discharge any firearm, adr r-iTIe, pellet gun. or any other weapon within the corporate limits of the Village of Plymouth except as follows: (a) Persons duly authorized to act as law enforcement officers, or members of the military forces of the United States or the State of Minnesota in the discharge of their duties. (b) Persons engaged in target shooting, with inanimate objects as targets within a building or structure totally enclosed where the sound of the shooting or discharge will not be a nuisance to persons occupying adjacent property. (c) Persons engaged in target or trap shooting on target or trap shooting ranges licensed as such by the Village Council (d) Persons acting in self-defense when the use of firearms for that purpose would not be otherwise unlawful. (e) For the destruction of diseased, injured or dangerous animals, birds or reptiles by persons specifically authorized to do so by the Clerk -Administrator. (f) Persons engaged in target shooting with bows and arrows provided that such target shooting does not occur within 300 yards of any dwelling. 4.02. LICZNSE REQUIM. No person shall operate a target or trap shoo ng range, nor shall permit target or trap shooting upon any property or premises owned or controlled by him, until a license for such activity has been granted by the Village Council. In considering the issuance of such a license the Council shall be satisfied that such target or trap shooting shall not be a hazard or a nuisance with respect to persons or property on the licensed premises or property adjaceat thereto. The Council, in granting such a license, may prescribe the hours during which such shooting is permitted and the caliber of rifle or other firearms which may be used. The license may be revoked by the Council after dotice and a hearing if the Council finds that this section has been violated or that the target or trap shooting range has become dangerous or a nuisance. 4.03. LICENSE APPLICATION. The application for the license shall state Me location of the place where the target or trap shooting is to occur, the number of persons who will engage therein, and such additional information as the Council may request. 4.04. LICENSE FEE, The annual license fee for a target or trap shooting range shall be $75.00. 4.05. PERMIT. (a) The Clerk --Administrator may grant a permit to any person upon application for the use of firearms for the destruction of diseased, injured or dangerous animals, birds or reptiles, but no such permit shall be valid for longer than twenty-four (24) hours. No fee shall be charged for such a permit. (b) A permit may also be issued by the Clerk -Administrator to any person for use on the property for whom the permit is granted for the use of firearms for the destruction of crows, rabbits, skunks or similar small animals or birds which are a nuisance or which are causing damage or injury to``trees or crops; Such permit shall be valid until December'31 of the,year in which granted and shall be�issued upon the p payment of a fee of $2.00. 4.06. CIYIL LIABILITY.:' _Nothing in thissCode shall authorize the use of any firefwms,.a:r rifle, pellet gun or ,.;other weapon in a manner which will endanger any human being or property, and no license or permit granted hereunder shall in any way relieve the per- son acting thereunder from civil liability for any, damage resulting from such use."
