ORDINANCE NO. 67-8
AN ORDINANCE PROVIDING FOR DISPOSITION OF
LOST AND UNCLIAMED PROPERTY FOUND WITHIN
THE VILLAGE OF PLYNOWN
THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. The Ordinance Code of the Village of Plymouth
is hereby amended to include the following as Section 12 of
Chapter II:
"Section 12. PROCEDURE FOR DISPOSITION OF LOST
AND UNCLAIMED PROPERTY.
12.01. Finder of Lost Property to Notify Owner
or Pblice Chier. Any person KInding any goo . articles,,
money, or o r personal property which is not his own
In or on any public place within the Village, shall
Immediately notify the owner and deliver the same to
such owner if such owner is known to his, man d if not,
so known, than he shall, within 48 hours after such
property has been. -no found, deposit such lost property
with the Police Department. of the Village: Provided,
however, that any person finding such property shall
not be required to transport it either to the owner
or to the Police Department.
12.02. Police Department to Provide for Custody
of Lost Property. The Irolice. Empartment snall ma

deposited with it or of -any property acquired by it
in the ordinary course of its police work in such
manner as shall be directed by the Clerk -Administrator.
12.03. Procedures for Claiming Lost Property. Any
such property so pos a ce par meat
or -acquired by it in the course of its police work shall
be retained in custody for a period of at least six
months fr the purpose of giving the owner thereof the
opportunity to claim the same. If any person shall claim
to be the owner of such lost property he shall file
an affidavit with the Clerk-Admi.n'Rtrntor setting forth
the fact of his ownership and the circumstances under
which the said lost property was lost or misplaced by
his, and that the sane was not abandoned by his. The
Clerk -Administrator shall thereupon notify the person
who found such property and deposited it with the
Police Department and if requested shall show such
affidavit to such person. If, after ten days from the
date of giving notice to such depositor, no claim is
asserted by such depositor and the Clerk -Administrator
is satisfied that the claimant is the rightful owner,
he shall turn over said property to said claimant pro-
vided such claimant presents himself at the place of
custody and safekeeping of such property prepared to
transport such property. If the Clerk -Administrator
has any doubt as to the claim of the claimant or if
the person who found and deposited such property
asserts a claim thereto, the Clerk -Administrator shall
refer the matter to the Village Attorney for a deter-
mination of the rights of the respective parties. {

12.04. Disposal of Unclaimed Lost Property. If
no persons 11 claim any such property on deposit with
the Police Department within six months from the date
of deposit thereof, or from the date of acquisition thereo;-
by the Police Department in connection with its police i
work, the Clerk -Administrator shall cause a notice
to be published in the official newspaper of the Village
describing such lost property, the date when found and
the place where found which notice shall further state
that if such property is not claimed within thirty days !
from date of publication of such notice such property will;
be deemed to be abandoned and will be delivered to the
finder or disposed of by public sale.
12.05. Sale and Disposal of Abandoned Property.
If no person shall claim suc os property as owner
within the thirty day period as provided in Section 12.04
above, such property shall be deemed to be abandoned.•
Thereafter the finder thereof shall be entitled to
possession thereof. Such property as in abandoned and
not claimed by the finderor if there is no person who
is otherwise entitled to the property, it may be sold
to the highest bidder at public sale in such faddon as
the Clerk -Administrator may direct. Notice of such
sale shall be published in the official newspaper of the
Village and the proceeds of such sale shall be paid to
the Village Treasurer and credited by him to the general
fund of the Village."
Section 2. This Ordinance shall be effective upon its
passage and publication.
Adopted by the Village Cnuncil the 26th day of : June
1967.
