ORDINANCE NO. 66-25
Ar, Ordinance Establishing Rates
and Charges for Sanitary Sewer

sota.
The V i11ag4 Council of the Vil-
lage of Plymouth does hereby
ordain as follows-.
Section 1. Definitions.
Unless the context specifically
indicates otherwise, the meaning
of terms used in this ordinance
shall be as follows:
1.01 ---"Person" shall mean any
individual, Orin, company, asso-
ciation, society, corporation, or
group.
1.02 — "Sanitary sewer" shall
mean a sewer which carries sew-
age and to which storm, surface,
and ground waters are not in-
t �!ntionaily admitted.
1.03 — "Multiple dwelling" is
hereby defined as any structure
occupied or intended to be oc-
cupied exclusively for residence
purposes and containing two or
more separate residential units.
1.04 -- "Motel", ",Hotel", and
"Motor Hotel" is any building or
portion thereof where lodging is
offered to transient guests for
compensation.
1.05—"Commercial building" is
defined as a single establishment
being operated as a comrnercial
enterprise. Each such establish-
ment in a shopping center com-
plex or within a group of similar
establishments. although housed
within a single structure, shall be
regarded as a separate commer-
cial building for purposes of this
ordinance.
1.06—"Industrie' building"
means a single estai.-ishment op-
erating as an industrial enter-
prise. Each such establishment
whether within a group of sim-
ilar establishments or housed
within a single structure shall be
regarded as a separate industrial
building for purposes of this or-
dinance.
Section 2. Rental charges for use
of Sewers.
2.01—An annual charge is here-
by imposed upon every person
whose premises are served by the
sanitary sewer system of the Vil-
lage of Plymouth, either directly
or indirectly, for the use of the
facilities of the said sewer sys-
tem and for ce anection therewith,
which charge shall be as herein-
after provided in Section 3 of this
u dinance. Said charge shall be
payable quarterly in advance and
shall be. subject to the penalties
set forth in Section 3 hereof if
not paid within 15 days from and
after the beginning of each quar-
ter. Such charges for sewer serv-
ice shall be a charge against the
owners, lessee, or occupant of the
premises served, any one of whom
shall be charged and billed for
the said services, and all such
charges which have been billed
and not paid within 30 days after
the beginning of each quarter
may be certified to the County
Auditur of Hennepin County as
an assessment against such prop-
erty ser -•,ed, and shall be collect-
ed as when taxes are collected.
2.02• --The obligadon to pay the
,charges herein specified shall be
incurred as of the time of connec-
tion of any private sewage dis-
posal system with the village
sewer.
Section 3. Sewer rental rates.
Charges for sewer service with-
in the village shall be at the fol-
lowing rates:
3.01 — Single family dwellings
and churches—rate per year $32,
penalty 10% of the delinquent
amount per quarter.
3.02 --Multiple dwellings—rate
per year $32 per unit, penalty
10% of the delinquent amount
per quarter.
3.03—Motels, hotels, and motor
hotels --rate per year $16 per unit,
penalty 10% of the delinquent
amount per quarter.
3.04—Trailer courts and mobile
home parks — $32 per unit per
year, charged quarterly, on the
basis of the number of trailer
homes in place in the park at the
commencement of each quarter,
penalty 10% of the delinque.a
amowit per quarter.
3.05 Commercial buildings, in-
dustrial buil,.ngs and schools
(including private schools al-
though attached to or operated by
churches)—rate per year to be
based upon metered consumption
of water for each quarter of each
calendar ,year to which the fol-
lowing rates will be applied: $20
per quarter for the first 10,000
gallons, 34c per 1,000 gallons
thereafter, penalty 10% of the
delinquent amount per quarter.
The user may establish additional
meters so that the water being
discharged into the sanitary sew-
er system will be metered sepa-
rately from other water.
Section 4. Sewer bills.
4.01 —It is hereby made the
duty of the Village Clerk -Admin-
istrator to render to the owners,
lessees, or occupants of such
property on the first day of each
quarter bills for the amount of
the sewer rental charge herem-
above set forth. The funds re-
ceived from the collection of the
sewer rental charges shall be
kept separate from the general
or other revenues of the viil:.go
and when so collected shall he
placed in the Sanitary Sewer
Sinking Fund.
Section 5. Revision of sewer
rates.
5.01—The Village Council re-
serves the right to re -adjust the
rates and charges provided in
Section 3 hereof from time to
time.
Section 6. 'Waiver of claims.
6.03 — All persons who shall
make use of the se, :ver system of
the Village of Plymouth wheth-
er as owners, lessees, or occu-
pants of any land, building, or
premises served by such sewers
shall be deemed to waive any
claim or cause of action for dam-
ages claimed against the Village
of Golden Valley and the Villag::
of Plymouth as a result of the
backing up of sewers in any base-
ment in the Village of Plymouth
not intentionally caused by the
deliberate act of some employee
or agent of the Village of Plym-
outh.
Section 7. Repeal of Ordinance.
Ordinance No. 65-8 of the Vil-
lage of Plymouth adopted March
8, 1965, is hereby repealed.
Section 8. Violations.
Any person violating any of the
provisions of tisis ordinance shall
upon conviction thereof be pun-
ished by a fine of net to exceed
$100 or by imprisonment for not
to exceed 90 days.
Section 9. Effective date.
This ordinance shall take ef-
fect upon its passage and publi-
cation.

AN ORDINANCE ESTABLISHING RATES AND CHARGES
FOR SANITARY SEWER SERVICE IN THE VILLAGE OF
PLYMOUTH, HENNEPIN COUNTY, MINNESOTA
THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. Defia:itions.
Unless the context specifically indicates otherwise, the

a single structure shall be regarded as a separate industrial
building for purposes of this ordinance.
Section 2. Rental charges for use of sewers.
2.01 -- An annual charge is hereby imposed upon every per-
son whose premises are served by the sanitary sewer system of the
Village of Plymouth, either directly or indirectly, for the use
of the facilities of the said sewer system and for connection
therewith, which charge shall be as hereinafter provided in
Section 3 of this ordinance. Said charge shall be payable quarterly
in advance and shall. be subject to the penalties set forth in
Section 3 hereof if not paid within 15 days from and after the
beginning �,f each quarter. Such charges for sewer service shall
be a charge against the owners, lessee, or occupant of the
premises served, any one of whom shall be charged and billed for
the said services, and all such charges which have been billed
and not paid within 30 days after the beginning of each quarter
may be certified to the County Auditor of Hennepin County as
an assessment against such property served, and shall be collected
as other takes are collected.
2002 -- The obligation to pay the charges herein specified
shall be incurred as of the time of connection of any private
sewage disposal system with the village sewer.
Section 3. Sewer rental rates.
Charges for sewer service within the village shall be at
the following rates:
3.01 -- ;Single family dwellings and churches -- rate per
year $32, penalty 10% of the delinquent amount per quarter.
3.02 -- Multiple dwellings -- rate per year $32 per unit,
penalty 10% of the delinquent amount per quarter.

3.03 -- Motels, hotels, and motor hotels -- rate per year
$16 per unit, penalty 10% of the delinquent amount per quarter.
3.04 -- Trailer courts and mobile home parks -- $32 per
unit per year, charged quarterly, on the basis of the number of
trailer homes in place in the park at the commencement of each
quarter, penalty 10% of the delinquent amount per quarter.
3.05 -- Commercial buildings, industrial buildings and
schools (including private schools although attached to or
operated by churches) -- rate per year to be based upon metered
consumption of water for each quarter of each calendar year to
which the following rates will be applied: $20 per quarter for the
first 10,000 gallons, 301 per 1,000 gallons thereafter, penalty 10%
of the delinquent amount per quarter. The user may establish
additional meters so that the water being discharged inti► the
sanitary sewer system will be metered separately from other water.
Section 4. Sewer bills.
4.01 -- It is hereby made the duty of the Village Clerk -
Administrator to render to the owners, lessees, or occupants of
such property on the first day of each quarter bills for the amount
of the sewer rental charge hereinabove set forth. The funds
received from the collection of the sewer rental,charges shall be

and when so collected shall be placed in the Sanitary Sewer Sinking
Fund.
Section 5. Revision of sewer rates.
5.01 -- The Village Council reserves the right to re -adjust
