Dtl sidoe . 1.01 The term "public dump- ing place" shall mean any prem- ises situated within the corporate limits of the Village of Plymouth. Minnesota where tin cans, ashes, junk or other trash or refuse of any kind is caused or permitted by the owner thereof to be de- posited and accumulated by mem- bers of the general public. Section 2. Licsu s s Asquted. 2.01 No person shall operate or maintain a public dumping place, or shall cause or permit any premises owned or occupied by him to be used or maintained as a public dumping place without flrat obtaining a license from the Village Clerk to operate a pub- lic dumping place. 2.02 Any license so granted shall be for a period of one (1) year and the annual fee therefor shall be $50.00. 2.03 Application for any such :i(-nse shall be made in writing to the Village Clerk, shall date the name and address of the ap- plicant, the location of the prem- ises to be designated as a public dumping place and such other in- formation as the Village Council shall require. If the owner of the premises is not the applicant, the application shall be accompa- nied by a statement frauâ–ş the owner authorizing the use of the premises as a public dumping place by the applicant. Section 3. Regulations Applic- able to Public Duw4*q Places. 3.01 The licensee shall provide facilities on the premises for the control and extinguishing of fires. In this regard an applicant for a license for a public dumping place shall demonstrate that there are wells or other sources of water which can be used for such pur- poses before a license is granted. 3.02 Such public dumping place shall be operated only between the hours of 8:00 o'clock am. and 7:30 o'clock p.m., Monday through Saturday. 3.03 No materials may be burned on such public dumping place on Saturdays, Sundays, Mondays and legal holidays. No burning shall occur except be- tween the hours of 8:00 o'clock p.m. and 3:00 o'clock a.m. Cen- tral Standard nme, on the days when burning is permitted. 3.04 No licensee shall permit the accumulation of salvage ma- terial or junk on the licensed premises for a period in excess of sixty (60) days. 3.05 No tree stumps may be deposited or accepted for deposit in such public dumping place. 3.06 Either the licensee or a person designated by him must be at the licensed premises at all times during the periods of operation. Such person shall di- rect the deposit of refuse and shall tend any fires that are burn- ing when such activity is per - nutted. 3.07 No garbage or kitchen waste of any kind, grain or foods which may attract rats, or which are subject to decay shall be de- posited or permitted to remain upon any licensed premises. 3.08 The premises so licensed shall be kept and i.iaintained in as dean and orderly a condition as is practicable and no rubbish, papers or other materials shall be permitted to be strewn or scat- tered upon the premises so as to be allowed to be carried there- from by the grind, and no nuisance shall be permitted to be main- tained upon such premises. 3.09 The Village Council may, at any reasonable time, designate any Village employee to inspect the licensed premises for the pur- pose of enforcing the provisions of this ordinance and it may be required as a further condition to the granting or continuance of such license at any time, that the licensee shall cause rats and other rodents, which may be pre- sent upon the licensed premises and any adjacent lands under control of the licensee to be ex- terminated by such methods as the Village Council may approve. If it is determined that rats or rodents are present in a public dumping place and if the licensee does not exterminate such rats and rodents the Village of Plym- outh, through its authorized agents may enter the licensed premises, exterminate such rats or rodents and certify the cost thereof to the County Auditor of Hennepin County, Minnesota, for assess- ment by him against said licensed premises. 3.10 It shall be a L ondition to all licenses granted hereto and to the continuance of any license heretofore or hereafter granted that a violation of any of the pro- visions of this ordinance shall be grounds for the revocation or suspension of such license. The Council may revoke or suspend such license only after a hearing on the question. The licensee shall be given ten (10) days writ- ten notice of such hearing and said notice shall be personally served upon the licensee in the manner pavacribed for the service of a summons in a civil action. 3.11 It shall be a condition to all licenses granted hereto and to the continuance of any license heretofore or hereafter granted that the Village shall have the right, through its agents and officers, to enter upon the licensed premises at all reasonable Mmes for the purpose of inspection thereof and for the purpose of extermination of rats and other rodents, and the elimination of any fire hazard or nuisance, and the termination or cancellation of any licenses shall not affect the rights so reserved by the Village. Section 4. Penalties. 4.01 Any person violating any of the provisions of this ordi- nances may be punished by a fine of not to exceed $100.00 or Im- prisonment for a period of one not to exceed ninety (90) days. Each day with respect to which such violation occurs and contin- ues shall be deemed to be a sep- arate violation. Section 5.
