An Ordinance Licendug and Reg-
ulatins the Leasing of Motor
Scooters and Motorcycles and
Regulating Theft Use
The Village Council of the Village
of Plymouth Do Hemby Ordain
As Follows;
Section 1. Definitions
1.01. `Motor Scooter" and "Mo-
torcycles" shall mean every motor
vehicle as defined by Section
188.01, Subdivision 3, of Minne-
sota Statutes 'raving a saddle for
the use of the rider and designed
to travel on not. more than three
wheels in contact with the
ground, including bicycles with
motor attached, but excluding a
tactor.
1.02. "Motor Scooter Business
and "Motorcycle Business" shall
ocean the t usinew of leasing,
renting or furnishing motor scoot-
ers or motorcycles for a con-
sideration.
1.03. "Person" shall mean any
person, partnership, corporation
or association of persons.
Section 2. License Required and
Fees
2.01. No person shall engage in
the business of leasing, renting,
furnishing or offering to lease,
rent or furnish motorcycles or
motor as defined here-
in, within the Village of Ply -
month without first obtaining
from the Village a license as pro-
vided herein.
2,02. Each license shall be is-
sued for one calendar year from
January 1st to December 31st of
said year and the fee therefor
shal! be $100.00. No license shall
be issued for the fractional part
of any year.
2.03 Applications for such li-
cense shall be made to the Vil-
lage Clerk on forms prescribed
by him and shall be subject to
the approval of the Village Coun-
cil.
2.04. Each person applying for
such a license shall accompany
his application with an insurance
policy in force with an insurance
company authorized to do busi-
ness in the State of Minnesota,
which policy must be in force
for the entire license year or
the remaining portion thereof cal-
culated from the date of the ap-
plication. Such policy shall in-
sure the applicant, his lessees,
renters and bailees using appli-
cant's motorcycles or motor
scooters, against loss in the sum
of at least #50,000 for injury or
death of any one person in any
one accident and $100,000 per in -
try to or death of two or more
persons in any one accident and
$5,000 because of damage to or
destruction of property in any
one accident all resulting from the
negligent ownership, operation,
use or defective =edition of any
motorcycle or motor scooter be-
longing to applicant. Every such
policy of liability insurance
shall contain an endorsement to
the effect that such policy shall
cover operators and passengers
of motorcycles and motor scooters
leased or rented to minors and
further, that the Village of Ply-
mouth s1,,,U be notified by letter
addressed, io the Village Clerk
thereof at least five days prior
to the cancellation of any of such
policies of insurance.
2.05 Each person applying for
such a license shall accompany
his application with a list of the
vehicles which he proposes to
use for rental or lease, which list
shall describe such vehicles by
make, year and serial number.
Any replacement of such equip-
ment made by any licensee in
the course of the license year
shall be reported to the Village
Clerk within five days of such
replacement.
Section 3 Conditions of License
3.01. The licensee shall not rent
or lease a motorcycle or motor
scooter to any person, except as
such person shall have a valid
Minnesota driver's license in his
possession and subject to the 11-
mitations as prescribed thereon.
3.02 All vehicles shall be kept
in good operating condition by
the licensee and the Village,
through its appropriate agents and
employees, is entitled to make
periodic inspections of such ve-
hicles. All such vehicles shall
be numbered and shall be marked
so as to be easily identifiable as
rented vehicles.
3.05, The licensee, his agents
or employees, shall explain the
operation of such motorcycles or
motor scooters including the con-
trols, pedals, gears, and brakes
of the particular vehicle to be
used by each person leasing or
using the same prior to the time
when it is operated by such per-
son. The licensee shall call the
attention of the lessee or bailee
to the high degrt; of maneuver-
ability of a motorcycle or motor
scooter and the lack of protection
to the driver thereof if the ve-
hicle is upset.
3.04. No rental of motor scoot-
ers and motorcycles shall be per-
mitted by any licensee between
the hours of 9,00 o'clock P.M.
and 8:00 o'clock A.M. on any
day.
Section 4. Investigation of Lo-
cation
4.01. The Chief of Pollee shall
cause an investigation to be made
of the traffic conditions prevail-
ing in the immediate vicinity of
applicant's proposed place of busi-
ness and make a report thereof
to the Village Council. Particu-
lar attention shall be given to
such traffic conditions on week-
ends and holidays.
Section 5. Operation of Motor
Scoote" and matorczelm
5.01. No person operating a
motor scooter or motorcycle with-
in the Village of Plymouth shall:
a. Allow any passenger to
ride on such rented vehicle.
b. Operate any such vehicle
while standing on same or
perform any trick riding or
operate in any manner oth-
er than in a customary man-
ner for operating such ve-
hicle.
c. Operate any such vehicle
upon any sidewalk in the
Village of Plymouth.
d. Operate any such vehicle
upon any public street or
public highway within the
Village of Plymouth abreast
of any other person riding
or propllling a bicycle, mo-
torcycle or motor Scooter.
5.02. Every person operating
a motor scooter or motorcycle
within the Vitae of Plymouth
shall observe all traffic rules and
regulations applicable thereto,
shall not make U turns, shall
signal for all turns, ride at the
extreme right hand side of the
street or highway, and shall peas
to the left when overtaking other
vehicles and pedestrians that are
slower moving.
Section 6. Penalties
6.01. Any person violating any
of the provisions of the Ordinance
shall be guilty o: a misdemeanor
and upon conviction thereof shall
be punished by a fine not exceed-
ing $100.00 or imprisonment not
exceeding 90 days.
Section 7. Wee wo Data
7.01. This Ordinance shall take
effect upon its passage and pub-
lication.
Adopted by the Village Coun-
cil of the Village of Plymouth,
Minnesota the 7th day of June,
1965.
