ORDINANCE NO. 65-9
An Ordinance Regulating the
Presence of Minors Under the
Age of Eighteen Years an the
Streets or in Public Places Be-
tween Certvin Hours
The Village Council of the Vil-
lage of Plymouth Do Hereby Or-
dain As Follows:
Section 1. Persons Under the
Age of 15 Years. It shall be un-
lawful for any person under the
age of 15 ,years to be on or pres-
ent in any public street, avenue,
alley, park or other public place
in the Village of Plymouth be-
tween the hours of 10:00 p.m.,
Official City Time and 5:00 a -m.
of the following day, unless ac-
companied by his or her parent
or guardian, or person having
legal custody and control of his
or her person, or unless there ex-
ists a reasonable necessity there-
for. The fact that said child, un-
accompanied by parent, guardian,
or other person having legal cus-
tody, is found upon any street,
alley, or public place after 10:00
p.m, or before 5:00 a.m. of the fol-
lowing day, shall be evidence that
said child is there unlawfully and
that no reasonable excuse exists
therefor.
Section 2. Persons Under the
Age of 18 and Over the Age of 14
Years. It shall be unlawful for
any person under the age of 18
,years and over the age of 14 years
to be on any public street, ave-
nue, alley, parks or other public
place in the Village of Plymouth
between the hours of 12:00 mid-
night and 5:00 a.m.. of the follow-
ing day. The provisions of this
section shad not apply to any
such minor ptrson who is accom-
panied by his or her parent, guar-
dian or other adult person having
the authorized care and custody
of such minor person, or when
such minor person is upon an
emergency errand or legitimate
business directed by his or her
parent, guardian or adult person
having authorized care and cus-
tody of such minor person or is
engaged in planned or organized
youth activity under the direction
of a school, church or community
organization. The fact that said
minor, unaccompanied by parent,
guardian, or other person having
legal custody, is found upon any
street, alley or public place after
12:00 midnight or before 5.00 a.m.
of the following day, shall be evi-
dence that said minor is there un-
lawfully and that no reasonable
excuse exists therefor.
Section 3. Responsibdilify o[ Par-
ents. It shall be unlawful for any
parent, guardian, or other person
having the legal custody and con-
trol of a minor under the age of
18 years to knowingly or negli-
gently permit such minor to vio-
late the provisions of section one,
two and three of this ordinance.
Section 4. Responsibility of Per-
sons in Charge of Places of
Amusement.
4.01 It shall be unlawful for
any person, firm or corporation
operating or in charge of any
place of amusement, entertain-
ment, or refreshment, or any oth-
er place of business to permit any
minor under the age of 18 years
to loiter, loaf or idle in such a
place during hours prohibited by
this ordinance.
4.02 Whenever the owner or
person in charge or in control of
any place of amusement, enter-
tainment, refreshment, or other
place of business shall find per-
sons under the age of 18 years
loitering, loafing, or idling in such
place of business, he shall imme-
diately order such person to
leave, and if such person refuses
to leave the said place of busi-
ness, the operator shall imme-
diately notify the police depart-
ment and inform them of the vio-
lation.
Section 5. Existing Laws. This
ordinance shall not be construed
as permitting the presence at any
time of any person under the age
of 18 years in any place where
his presence is now prohibited by
any existing law or ordinance.
Section 6. Power of ArrewL Any
member of the police force is
authorized to arrest, with or wM-
out warrant, any person or per-
sons observed to be violating the
Provisions of Sections 1, 2, and 8
and 4 of this ordinance, and aball
notify, as soon as reasonably pos-
sible, the parents, guardian or
person having legal custody of
any .minor so arrested.
Section 7. Penalties. Any per-
son violating any of the provi-
sions of this ordinance shall, upon
conviction, be punished by a fine
not exceeding $100.00 or by im-
prisonment for a period not ex-
ceeding ninety (90) days.
Section 8. Repeal of Ordinance.
Section 9 of Ordinance 594 of the
Village of Plymouth, adopted
February 3, 1959, is hereby re-
pealed.
Section 9. Effective Dat. This
ordinance shall take effect upon
its passage and publication.
