sewn service in the Village of
Plymouth. Hornsptn County.
Minnesota.
THE VILLAGE COUNCIL OF
THE VILLAGE OF i-LYMOUTH
DO HEREBY ORDAIN AS FOL-
LOWS:
Section 1. Definitions. Unless
t1a language clearly indicates
that a different meaning is in-
tended, the following terms and
phrases shall be given the mean-
ing set out below for the purposes
of this ordinance:
I.Q1—"Normal Sewage" is wa-
ter -carried waste products from
residences, public buildings, busi-
ness or industrial establishments,
schools, or any other buildings or
structures, including the excre-
mentitious or other discharge
from human beings or animals,
together with such ground water
infiltration as may be present.
1.02 --"Industrial Waste" is any
liquid, gaseous or solid waste sub-
stance resulting from any process
of industry, manufacturing, trade,
business, the development of any
natural resounx or any similar
activity.
Section 2. Rafe.
2.01—The following rates and
charges for use and service of the
sanitary sewer system are hereby
established, such charges and
rates to be made against each
lot, parcel of land, unit or prem-
ises which may have a connec-
tion directly or indirectly, into the
village sanitary sewer system and
which discharges only normal
sewage into such system:
A. Computation of Quarterly
Charges:
(a) Charges for use of Gold-
en Valley Sewer System shall
be computed quarterly based
upon the rates and charges as
established in the contract be-
tween the Village of Plymouth
and Village of Golden Valley.
(b) Charges for hauling sew-
age from sanitary sewer hold-
ing tanks to point of disposal
into the Golden Valley sanitary
sewer system shall be comput-
ed quarterly based upon con-
tract cost for hauling sewage.
(c) The quarterly charges for
sanitary sewer service shall be
made on the following basis:
(1) The sewer rental charge
imposed by the Village of
Golden Valley shall be billed
to the benefited properties
provided with sanitary sew-
er laterals at the rate of $9.45
per acre.
(2) Individual users of the
sanitary sewer service will be
charged on the basis of actual
use. A rate charge per 1000
(M) gallons of sewage shall
be determined by adding the
rates charged by the Village
of Golden Valley plus the to-
tal contract cost of hauling
sewage plus 15% of the to-
tal of both amounts and di-
viding the figure so obtained
by the total water meter
readings. Individual charges
will thereafter be deter -
rained by multiplying the
quarterly water meter read-
ing of the individual user by
the quarterly rate charge per
1000 (M) gallons.
Section 3. Metering Water Sup-
ply. A meter recording the use
of water shall be installed on any
nonresidential lot, parcel, prem-
ises or unit enumerated in Sec-
tion 2 of this ordinance, and
thereafter the charges shah be
based upon such use of water.
Section 4. Instaliation of Meter.
Any water meter installed for use
or used as a basis for the com-
putation of sewer rates shall be
installed and maintained in good
operating condition at all times,
such installation and maintenance
to be without expense to the vil-
lage. Any such meter shall be of
a type approved by the Village
Council, and shall accurately
measure all water received on the
premises. Installation of a n d
maintenance of such meter shall
be made in accordance with the
plumbing regulations of this vil-
lage.
Section 5. Water Used Not En.
tering Sewer System. If the lot,
parcel of land, or premises dis-
charges normal sewage of indus-
trial waste into the sanitary sew-
erage system, either directly or
inidrectly, and it can be shown
to the satisfaction of the Village
Council that a portion of the wa-
ter measured by the water meter
does not and cannot enter the
sanitary sewerage system, then,
and in that event, the Village
Council may permit or require
the installation of other or addi-
tional meters in such a manner
that the quantity of water which
actually could enter the sewer
system may be determined. In
such case the charges or rates
shall be based upon the amount
of water which can enter the san-
itary sewerage system.
Section 6. Supplying Informa•
tion. The owner, occupant, or per-
son in charge of any premises
shall supply the village with such
information as the village may
reasonably require related to use
of water, use of sewer, or sewer
rates. Wilful failure to provide
such information or wilful falsifi-
cation of such information shall
constitute a violation of this ordi-
nance, as shall wilful failure to
comply with any requirement or
order issued pursuant to this or-
dinance.
Section 7. Estimated $ills. If
the owner, occupant or person in
charge of any premises shall fail
ur refuse to provide information
as provided in Section 6 hereof,
or shall fail or rellise to comply
with any requirement of this or-
dinance, the proper charge for
such premises shall be estimated
and billed in accordance with
such estimate.
Section 8. Beginning Service.
"."or to commencing sanitary
sewer service, water meters shall
have been installed A meter
readings shall have been record-
ed by the village.
Section 9. Billing. Bills for
charges for the use and service
of the sewerage system shall be
made out by the Village Clerk in
accordance with the usual and
customary practice. All bills shall
be payable at the office of the
Village Clerk. Bills shall be ren-
dered quarterly.
Section 10. Collections. All bills
shall be due and payable when
rendered. If payment is not made
within ten days of mailing of the
bill, a penalty of 10% or 50 cents,
whichever is greater, shall be
added to the amount due on such
bill. When a charge I- more than
45 days past due civil action may
be begun on behalf of the village
for the collection of said sewage
service charge, and if such charge
is not paid within 60 days after
due, the said unpaid charge plus
penalty may be certified to the
County Auditor with the taxes
against such property ar d shall
be collected with other fixes on
such property.
Section 11. Dis' . ibution of Rev-
enue. All revenueF derived from
these rates and charges shall be
credited to the Sewer Operating
Fund. Such revenues shall be
used only for the purpose of pay-
ing the cost of operating and
maintaining the sewage system,
paying charges made by the Vil-
lage of Golden Valley, providing
an adequate depreciation fund,
paying costs of meter--oading,
billing, rillection and othrr simi-
lar or related sewer operating ex-
penses.
Section 12. Violations. Any per-
son, firm or corporation violating
ai,y of the provisions of this ordi-
nance, shall u p o n conviction
thereof be punished by a fine of
not to exceed $100 or by im-
prisonment for not to exceed 90
days.
Section 13. Effective Date. This
ordinance shall take effect upon
its passage and publication.
Adopted by the Village Coun-
cil the 8th day of March, 1965.
