ORDINANCE NO. 63-8
AN ORDINANCE REGULATING
CESSPOOLS! AND SEPTIC
TANK OPENINGS AND
REGULATING SCAVENGERS
THE VILLAGE COUNCIL OF
THE VILLAGE OF PLYMOUTH
DO HEREBY ORDAIN AS FOL-
LOWS:
Section 1--Dellallimm
1.01—The word "scavenger,"
when used in this ordinance,
shall mean a person who cleans
a privy, vault, cesspool, septic
tank, or private drain, and re-
moves the contents therefrom.
Section 2—Permits Required.
2.01—In the event that a cess-
pool or septic tank within the
Village of Plymouth must be
opened in order to remove the
contents of the some, a permit
must first be secured from the
Building Inspector, and a fee of
$1.00 shall be paid for such per-
mit.
2.02 --No person other than a
properly licensed scavenger shall
clean any sanitary or plumbing
facility listed in Section 3 hereof,
nor shall any person deposit any
of the contents thereof in any
unauthorized place within the
Village of Plymouth.
Section 3—License Rrquked,
3.01—No person shall follow or
practice the occupation of scav-
enger, or act as a scavenger with-
in the Village of Plymouth with-
out first having obtained a license
as herein provided. No person
shall empty the contents of any
privy, privy box, vault, sink, sep-
tic tank or cesspool located with-
in the Village of Plymouth unless
being -o licensed
3.02—The application for a
scavenger license shall state:
(a) The name and address of
the applicant.
(b) If the applicant is not an
individual, the names and ad-
dresses of all officers or other
persons in control of the firm or
corpora tion applicant.
(c! P description of the equip-
ment which the applicant pro-
poses to use for scavenging with-
in the Village.
(d) The maximum rates or
prices which the applicant pro-
poses to charge for scavenging
within the Village.
3.03 ---The annual license fee for
such license shall be $25.00.
Section 4—Regulations.
4.01—No scavenger or other
person shall empty or remove the
contents cf any vault, privy,
cesspool, septic tank or drain,
otherwise than in a container
made tight and closely covered
and at such hours or times of the
day or night as the Health Offi-
cer or Chief of Police of the Vil-
lage may direct.
4.02—No scavenger or other
person shall, in the Village of
Plymouth, place, keep or store,
when not in actual use, any scav-
enger box, cask, cart, tank, ves-
sel, container, vehicle, or tools,
used in scavenger service, within
300 feet of any private residence,
school building, church building,
hotel, theater, public or private
hall, restaurant, or any public
grounds or public building with-
in said Village.
4.03 --No scavenger, or other
person, shall dispose of the con-
tents of any vault, privy, cess-
pool, septic tank, or other private
drain in any place within the
Village of Plymouth without first
notifying the Village Health Of-
ficer, or the Chief of Police, in
writing, of the place where it is
proposed to make such disposal.
No scavenger or other person
shall dispose of such contents by
depositing same on the open
ground or in any well, open
stream or body of water within
the Village, and all such contents
shall be either buried under at
least 1 foot of earth in a place,
or disposed of in such other place,
as may be designated and ap-
proved by said Health Officer or
Chief of Police.
4.04 --No scavenger or other
person shall remove or cause to
be removed, or carried, within
the Village of Plymouth, the con-
tents of any privy, vault, cesspool
or septic tank in any container
or vehicle except such as shall
be approved by the Chief of Po-
lice and under no circumstances
shall any container or vehicle be
used for such purposes that might
become saturated with offensive
liquids and thereby become a nui-
sance in itself.
4.05—No licerse shall be issued
unless and until the person, firm,
association, partnership or cor-
poration applying for such license
shall first file with the Village
Clerk a corporate surety bond in
the principal amount of $2,000.00,
conditioned upon the faithful per-
formance by the applicant or his
agents of all things required by
the ordinances of the Village of
Plymouth, and shall be further
conditioned so as to. guarantee
that said applicant will restore
aL' streets, alleys, or other pub-
lic grounds, or sewers, manholes,
or appurtenances thereto to their
former good condition, to the sat-
isfaction of the Village Council
if any such public property is
damaged by the applicant or his
agents in the course of operating
as a scavenger.
4.06—When requested by the
owner or occupant of any prem-
ises, any scavenger licensed here-
under shall clean or empty any
vault, privy, cesspool, septic tank
or private drain, and remove any
and all nuisances. From such
places he may demand, and re-
ceive, in advance, his fees for
services, but not exceeding the
maximum rate specified in his
application for license.
4.07—Any scavenger licensed
hereunder shall have the power
under the direction of the Chief
of Police to enter upon any prem-
ises between sunrise and sunset
for the purpose of ezemining any
vault, privy, cesspool, septic tank
or private drain, and shall be
permitted access to any and all
parts of any dwelling or building
within the Village of Plymouth
necessary for such examination
and for the purpose of cleaning
the same when necessary.
Section 5 — Expiration of Per-
mitL
5.01—All permits issued here-
under for the opening and remov-
ing the contents of a cesspool or
septic tank shall be dated and
shall be invalid one calendar
week after their issuance.
Section 6—Vtolations-
6.01—The violation of any of
the provisions of this ordinance
by a licensed scavenger shall re-
sult in automatic revocation of
such license.
6.02—Any person violating any
of the provisions of this ordi-
nance shall, upon conviction
thereof, be punished by a fine
of not to exceed $100.00 or by
imprisonment for not more than
90 days.
Section 7—EReetive Date.
7.01—This ordinance shall be
effective upon its passage and
publication.
