nance No. 59-4 Relating to Mis-
demeanors and Repealing Cer-
tain Pordons Thereof
The Village Council of the
Village of Plymouth Do Hereby
Ordain As Follows:
Section 1—Rapeal of Portions
of Ordinance No. 59-4.
Section 3 of Ordinance No. 59-4
of the Village of Plymouth,
adopted February 3, 1959, is here-
by repealed.
Section 2—Amendment of Or-
dinance No. 59-4.
Ordinance No. 59-4 of the Vil-
lage of Plymouth, adopted Feb-
ruary 3, 1959, is hereby amended
by adding the following thereto
as Section 9A:
Section 9A—Prohibited Acts.
9A.01 DeBnWons. Where used
in this ordinance, the following
words shall have the following
meanings:
a. Public Place. The words
"public place" shall include
streets, alleys and sidewalks
dedicated to public use and
shall also include such parts of
buildings and other premises
whether publicly or privately
owned which are used by the
general public, or to which the
general public is invited com-
mercially, for a fee, or other-
wise, or in or on which the
general public is permitted
without specific invitation.
b. Person. The word "pu-
son" shall include individuals,
firms, partnerships, corpora-
tions, &_-br, associations, and
organizations, and shall further
include officers, agents and em-
ployees thereof.
9A.02 Begging. No person in
any public or private place shall
beg from strangers for money or
other property, other than solici-
tation for recognized charities.
9A-03 Public Drunkenness. No
person shall be in any public
place while obviously or helpless-
ly under the Uluence of alcohol.
9A.04 Making Unnecessary
Noise. No person, in any public
or private place, shall make, or
..ssist in making, by any manner
or means, any loud, unpleasant or
raucous noise or odor disturbing
to others unless the same be rea-
sonably necessary to the preser-
vation of life, health, safety or
property.
9A.05 Disturbing in a Theater.
No person, during the perform-
ance of the program in a theater,
auditorium, or place of amuse-
ment, shall wear any headgear or
conduct himself or herself in a
manner which interferes unrea-
sonably with the view or enjoy-
ment of another person of the
stage or screen or place of activ-
ity, nor shall any person operat-
ing such theater, auditorium, or
place of amusement permit the
wearing of any such headgear or
permit such conduct.
9A.06 Lurking. No person in
any public or private place shall
lurk, lie in wait or be concealed
with intent to do any mischief
or to commit any crime or unlaw-
ful act.
9A.07 Breach of the Peep. No
person, in any public or private
place, shall engage in, or prepare,
attempt, offer, or threaten to en-
gage in, or assist or conspire with
another to engage in or congre-
gate because of any riot, fight,
brawl, tumultuous conduct, act of
violence, or any other conduct
which disturbs the peace and
quiet of another save for partici-
pating in a recognized athletic
contest.
9A.08 Exhibiting Obscans Mat.
ter. No person in any public or
private place, shall prepare, ex-
hibit, or transfer in any manner
to another, or offer to so prepare,
exhibit, or transfer to another,
whether or not for a considera-
tion, any obscene or indecent
writing, picture, photograph,
drawing, design, model, or object,
or have any thereof in possession
with intent to transfer or exhibit.
9A.09 Pandering. No person in
any public or private place, shall
secure, or offer to secure, or en-
tice or attempt to entice, another
to engage in unlawful sexual in-
tercourse, prostitution, or any
lewd, lascivious, or indecent act;
nor shall any person accept know-
irrgly any part of the earnings of
a female from prostitution.
9A.10 Prostitution. No female,
in any public or private place,
shall offer or submit her body in-
discriminately for sexual inter-
course, whether or not for a con.
sideration.
9A.11 Indecent ConducL No
person, In any public or private
place, shall engage in, or offer or
attempt to engage in, or congre-
g.:e because of (a) lewd, lasciv-
ious or immoral conduct, (b) the
use of slanderous, foul, obscene
cr indecent language, (c) the in-
decent or lascivious exposure or
use of the human body, or any
part thereof, or (d) behavior,
whether by words or acts, of a
nature to corrupt the public mor-
als or to outrage the sense of
public decency.
9A.12 Participating in a Dbor.

own, lease, operate, maintain, re-
side in, visit or entice or attempt
to entice another to reside in or
visit, any building, or place, with
knowledge that unlawful sexual
intercourse, prostitution, lewd,

ing malt liquor occurs therein.

9A.13 Profanity and Obsoanity
in Public Places. No person shall
in any public place use ani pro-
fane or obscene language or ges-
tures to or in the presence of
another or to the annoyance of
other persons in such public
places.
Section 3—Effective Date.
This Ordinance shall take effect
upon its passage and publication.
