An Ordinance Amending Ordin-
ance No. 58 (Subdivision Ord-
inance) of the Village of Plym-
outh
The Village Council of the Vil-
lage of Plymouth do Hereby Or-
dain as Follows:
Section 1. Amendment of Ex-
isting Ordinance
Section 12 of Ordinance No. 58
Is hereby amended to read as
follows:
"Section 12. Park Areas
Section 12.01 The owner or
owners may be required, as a pre-
requisite to approval of the plat
or subdivision, to convey to the
Village, or dedicate to public use,
for a public park or playground,
a minimum of five per cent (5%)
of the area being platted or sub-
divided, and a maximum of ten
per cent (10%) of the area being
platted or subdivided.
Section 12:02. The Village may
require, in lieu of the convey-
ance or dedication provided for
in Section 12.01 above, the own-
ers or developer to pay to the
Village, for use in the acquisition
and development of public parks
and playgrounds, an amount
equal to $25.00 per acre for each
acre included in the plat or sub-
division.
Section 12.03. The owner or
owners may be further required
to convey to the Village, or dedi-
cate to public use, for public park
purposes, a strip of land fifty
(501) feet in width along each
bank of any watercourse which
lies wholly or partially within
the proposed plat or subdivision.
In such event the total amount of
land along said watercourse so
conveyed or, so dedicated, shall
be counted as a part of the total
required conveyance or dedica-
tion by the owner or owners un-
der Section 12.01 above. In the
event the Village requires a con-
tribution from the owner or own-
ers as provided in Section 1202
above in lieu of a conveyance or
dedication of land for public park
or playground purposes, the total
acreage in the plat or subdivision
shall be reduced by the amount
of land conveyed or dedicated
along the banks of any such wa-
tercourse for the purpose of de-
termining the amount of said con-
tribution due from said owner or
owners under the provisions of
Section 12.02 above."
Section 2. Effective Dab
This Ordinance shall become
effective upon its passage and
publication.
