RESOLUTION No. 2013-271
A RESOLUTION APPROVING CONDITIONAL USE PERMITS FOR RYANNE QUIRK FOR FUN
CITY DOGS FOR PROPERTY LOCATED AT 1005 STATE HIGHWAY 169 (201 3053)
WHEREAS, RyAnne Quirk has requested approval of conditional use permits for the site
legally described as follows:
That part of the north 200 feet of the south 230 feet of the east 525 feet of the northeast
quarter of the northeast quarter of Section 36, township 118, Range 22, lying westerly of
County Road No. 18, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by RyAnne Quirk for Fun City Dogs for conditional use permits to allow 1)
dog day/overnight boarding and 2) accessory retail/service up to 20 percent of the existing
building located at 1005 State Highway 169, subject to the following conditions:
I. Conditional use permits are approved to allow 1) a dog day/overnight boarding facility and
2) 20 percent of the principal building (1,774 square feet) to be used for accessory enclosed
retail sales and accessory grooming and spa services, in accordance with the application and
plans received by the City on June 7 and July 8, 2013, except as may be amended by this
resolution.
2. The conditional use permits are approved with the finding that all applicable conditional use
permit standards are met.
3. The permits are subject to all applicable noise, building and fire codes, and to all city
regulations and ordinances. Any violation thereof shall be grounds for revocation.
4. Prior to occupancy of the building, the applicant must obtain separate approval of a
building permit for the use of the building and installation of an eight -foot fence.
5. Prior to issuance of a building permit, the applicant shall submit the following consistent
with the zoning ordinance and city codes:
a. A parking lot striping plan indicating a minimum of 21 parking spaces.
b. The location of the garbage dumpster area.
c. An approved kennel license.

d. Fence details showing the style privacy fence to be installed.
6. Kennel licenses must be kept current as required by City Code.
7. Prior to occupancy of the building, the applicant shall stripe the parking spaces and request
an inspection to verify compliance.
8. The fence for the outside play area and parking areas shall not block the fire lane.
9. No outdoor storage, grooming or retail sales are permitted with the conditional use permit.
10. The facility shall be kept in compliance with the city's noise ordinance and remain in a
sanitary condition. Dog feces will be removed from the building, outdoor play areas and site
as needed for odor control.
11. Standard Conditions:
a. Any signage shall comply with the city's sign regulations.
b. All waste and waste containers shall be stored within approved designated areas.
c. Subsequent phases or expansions are subject to required reviews and approvals per
ordinance provisions.
d. This approval shall expire one year after the date of approval, unless the property owner
or applicant has started the project, or unless the applicant, with the consent of the
property owner, has received prior approval from the city to extend the expiration date
for up to one additional year, as regulated under section 21015.07 of the zoning
ordinance.
