RESOLUTION No. 2013-270
A RESOLUTION APPROVING A PRELIMINARY PLAT FOR K. HOVNANIAN HOMES OF
MINNESOTA, LLC FOR "CEDAR HOLLOW 2ND ADDITION" FOR OUTLOT A, CEDAR
HOLLOW ON PROPERTY LOCATED SOUTH OF STATE HIGHWAY 55 BETWEEN 46TH
AVENUE AND URBANDALE COURT (201 3064)
WHEREAS, K. Hovnanian Homes of Minnesota, LLC. has requested approval of a preliminary
plat for Outlot A, Cedar Hollow, a subdivision of two properties with roughly 27 acres presently
legally described as follows:
That part of the west '/2 of the southeast quarter of the southwest quarter of section 7,
township 118 north, range, 22, lying south of the southerly line of State Highway no. 55,
Hennepin County, Minnesota. And, the west '/z of the northeast quarter of the northwest
quarter of section 18, township 118 north, range 22, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by K. Hovnanian Homes of Minnesota, LLC. for a preliminary plat for "Cedar Hollow
2nd Addition", subject to the following conditions:
1. A preliminary plat is approved on Outlot A, Cedar Hollow to extend a public street to the
south property line and add three lots and two outlots to the east side of the proposed street,
in accordance with the application and plans received by the city on July 12, 2013, except as
may be amended by this resolution.
2. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances
are approved or implied.
3. No driveway access shall be permitted to the frontage road.
4. Prior to recording the final plat, the applicant shall: 1) submit draft deeds for the park
property and the trail outlot; 2) pay sewer and water area assessments; 3) receive city
approval of final constriction plans; and 4) execute a development contract and submit related
financial guarantees and fees.

5. Prior to final platting, the applicant shall fulfill the requirements, submit the required
information, and revise the plans as indicated below, consistent with the applicable city code,
zoning ordinance, and engineering guidelines:
(1) Provide HOA documents for the development that include language addressing the
following: 1) prohibition of strictures and clearing vegetation in wetland buffers and 2)
maintenance for common elements including buffer monuments, median plantings,
mailboxes, monument signs, shared retaining walls, sidewalks, etc.
(2) Submit a copy of the disclosure to be shown to the first homebuyer that Walnut Grove
Lane would be extended to the south in the fiiture and a trail extending east from
Walnut Grove Lane would be constricted in the fiiture and incorporate this language
into the HOA documents for the development for subsequent buyers.
(3) Submit fire flow calculations with each phase of the development and provide the total
square footage of the largest proposed stricture.
(4) Add a hydrant in an approved location on Walnut Grove Lane south of 43 a Avenue or
relocate the hydrant shown near the terminus to an approved location.
(5) Execute an encroachment agreement for retaining walls in drainage and utility
easements.
(6) Revise the plans to indicate a wetland buffer and buffer monuments for the wetland in
the southwest corner of the property.
(7) Revise the garage location on the following lots to meet the required setbacks from
intersections: Lot 4, Block 3 and Lot 7, Block 2.
(8) Revise the street name "Xantus" to "Xanthus".
(9) Revise the tree inventory to modify the calculations, as follows: 1) remove the trees on
adjacent properties from the calculations (continue to show them on the graphics) and 2)
indicate trees removed for trail constriction as exempt.
(10) Revise the plans to replace the five-foot sidewalk in front of the park property with an
eight -foot trail.
(11) Indicate a temporary turnaround north of the ditch on Walnut Grove Lane and provide
easements for all affected private properties.
(12) Add a park boundary marker in the southeast corner of the park property at the right-of-
way.
(13) Revise the plans to indicate that the trail extending east from Walnut Grove Lane shall
be graded at this time but not paved until the city acquires additional easements to
extend the trail to the east.
(14) Include a barrier in Walnut Grove Lane south of the temporary turn -around, but north of
the creek.
6. Prior to the issuance of a building permit, the applicant shall submit a survey indicating:
a. A minimum of two front yard trees to be preserved or planted, and
b. Silt fence and tree preservation fencing installed consistent with city code.

a. With the exception of a model home, no building permits shall be issued until the final plat,
deed for park property, agreements, and easements are filed and recorded with Hennepin
County.
b. Compliance with the city's tree preservation regulations.
c. Removal of all hazardous trees from the property at the owner's expense.
d. This approval shall expire one year after the date of approval, unless the applicant has
applied for final plat approval, or unless the applicant, with the consent of the property
owner, has received prior approval from the city to extend the expiration date for up to
one additional year, as regulated under section 510 of city code.
