HomeMy WebLinkAboutCity Council Resolution 2013-267CITY OF PLYMOUTH RESOLUTION No. 2013-267 A RESOLUTION APPROVING THE VACATION OF A DRAINAGE EASEMENT FOR PONDING AND A PORTION OF A DRAINAGE AND UTILITY EASEMENT IN LOT 1, BLOCK 1, PROVIDENCE ACADEMY WHEREAS, a public hearing with respect to said vacation was scheduled for August 13, 2013, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 13, 2013; and WHEREAS, the City Council did hold a public hearing on August 13, 2013, to inform any and all interested parties relevant to the vacation of a drainage easement for ponding and a portion of a drainage and utility easement in Lot 1, Block 1, Providence Academy; and WHEREAS, it was determined by the City Council that said easements are not needed for public purposes; and NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the ponding and drainage and utility easements described as follows be vacated. Drainage easement for ponding over, under and across that part of Lot 1, Block 1, Providence Academy, Hennepin County, Minnesota, described as follows: Commencing at the most northerly corner of said Lot 1; thence South 26 degrees 52 minutes 35 seconds West, assuming bearing, along the west line of said Lot 1, a distance of 45.97 feet; thence South 63 degrees 41 minutes 19 seconds East a distance of 234.06 feet to the point of beginning of the land to be described; thence South 63 degrees 17 minutes 55 seconds East a distance of 96.14 feet; thence South 14 degrees 39 minutes 09 seconds West a distance of 113.91 feet; thence South 66 degrees 59 minutes 03 seconds West a distance of 19.78 feet; thence North 57 degrees 01 minute 32 seconds West a distance of 126.19 feet; thence North 28 degrees 41 minutes 26 seconds East a distance of 81.94 feet; thence North 53 degrees 20 minutes 49 seconds East a distance of 34.47 feet to said point of beginning. Drainage and utility easement over, under and across that part of Lot 1, Block 1, Providence Academy, Hennepin County, Minnesota, described as follows: Commencing at the most northerly corner of said Lot 1; thence South 5 degrees 32 minutes 09 seconds West, assumed bearing, along said drainage and utility easement line a distance of 16139 feet to the point of beginning of the land to be described; thence South 27 degrees 11 minutes 45 seconds West, continuing along said easement line a distance of 216.80 feet; thence South 35 degrees 45 minutes 15 seconds West, along said easement line a distance of 192.06 feet; thence South 45 degrees 01 minute 16 seconds West, along said easement line a distance of 100.76 feet; thence South 60 degrees 39 minutes 37 seconds West, along said easement line a distance of 71.22 feet; thence North 86 degrees 34 minutes 08 seconds West, along said easement line a distance of 37.44 feet; thence South 12 degrees 28 minutes 08 seconds East, along said easement line a distance of 13.83 feet; thence North 45 degrees 01 minute 16 seconds West, along said easement line a distance of 54.81 feet; thence North 78 degrees 46 minutes 37 seconds East a distance of 62.16 feet; thence North 64 degrees 41 minutes 30 seconds East a distance of 50.45 feet; thence North 42 degrees 24 minutes 44 seconds East a distance of 119.76 feet; thence North 27 degrees 07 minutes 57 seconds East a distance of 97.66 feet; thence North 15 degrees 19 minutes 41 seconds East a distance of 64.12 feet; thence North 55 degrees 26 minutes 08 seconds East a distance of 65.58 feet; thence North 41 degrees 21 minutes 08 seconds East a distance of 42.47 feet; thence North 44 degrees 50 minutes 10 seconds East a distance of 123.28 feet to said point of beginning. FURTHER, that the recording of the new ponding easement shall be accomplished with, but following the recording of this resolution. FURTHER, that said vacation shall not effect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintain the same or to enter upon such way or portion thereof vacation to maintain, repair, replace, remove, or otherwise attend thereof.
