HomeMy WebLinkAboutCity Council Resolution 2013-265CITY OF PLYMOUTH RESOLUTION No. 2013-265 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR GWS LAND DEVELOPMENT OF PLYMOUTH, LLC. FOR "STEEPLE HILL 2ND ADDITION" FOR PROPERTY LOCATED AT 16440 COUNTY ROAD 47 (2013023F) WHEREAS, GWS Land Development of Plymouth, LLC has requested approval of a final plat for 51 new single-family lots on the roughly 21 -acre parcel presently legally described as follows: That part of Nvest 60 acres of Northeast '/4 of Section 5 Township 118 Range 22 lying north of the northerly line of Hennepin County Highway Number 47 except that part herein described as follows: commencing at northeast corner of said west 60 acres of the northeast quarter; thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east, 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly_ along said right of way to said east line; thence northerly_ along said east line to point of beginning. And, That part of west 60 acres of northeast '/4 Section 5, Township 118, Range 22, described as follows: commencing at northeast corner of said west 60 acres of the northeast quarter: thence on an assumed bearing of south 00 degrees 08 minutes 02 seconds east along east line of said west 60 acres of the northeast '/4, 496.14 feet to point of beginning, thence south 89 degree 51 minutes 58 seconds west, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right- of-wav line to said east line; thence north 00 degrees 08 minutes 02 seconds west 179.76 feet to point of beginning. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by GWS Land Development of Plymouth, LLC. for a final plat for "Steeple Hill 2"a Addition"; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FUTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Steeple Hill 2"a Addition is approved in accordance with the plans received by the city on July 2, 2013, except as may be amended by this resolution. Approval of the final plat is contingent upon Metropolitan Council review of the comprehensive plan amendment and City Council approval of a wetland mitigation plan. 3. No private driveway access from any lot shall be permitted to County Road 47. 4. Development standards shall be as approved with the PUD General Plan. No variances are approved or implied. 5. Prior to recording the final plat, the applicant shall: 1) receive City approval of final constriction plans; 2) submit a cash deposit for removal of the secondary access lane when the stub street is extended to County Road 47; and 3) execute a development contract and submit related financial guarantees and fees. 6. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with applicable city code or zoning ordinance requirements: a. Provide HOA documents for the development that include language addressing the following: 1) prohibition of strictures and vegetation clearing in the wetland buffers and 2) maintenance for common elements including buffer monuments, mailboxes, monument signs, shared retaining walls, sidewalks, etc. b. Execute an encroachment agreement for retaining walls that are constricted within drainage and utility easements on Lots 1 and 3, Block 1; Lot 22, Block 2; and Lots 40-42, Block 4. c. Submit an easement for all lots affected by the temporary turnaround. d. Add/relocate wetland buffer monuments as required by section 21670 of the zoning ordinance. e. Revise the tree inventory to indicate the following trees as disturbed: 455 and 456 and either amend the landscaping plan to add 54 additional replacement inches or an equivalent cash restitution as outlined in the subdivision regulations. f. Revise the landscaping plan, as follows: 1) clearly identify which trees are the responsibility of the developer and which are the responsibility of the builder; 2) relocate trees from wetland buffers and within 10 feet of utility mains; and 3) consider adding catalpa trees to the list of trees replanted in the subdivision and replanting the catalpa trees along the eastern property border. g. Relocate the temporary cul-de-sac off the proposed driveways. h. Submit specifications for the fence to be installed on the top of the retaining wall and along County Road 47. 7. The developer shall remove the temporary cul-de-sac on 61" Avenue and install the missing segment of sidewalk. 8. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of four three-inch trees, two of which are front yard trees, and Res. 2013-265 File 201302317 Page 3 b. Silt fence and tree preservation fencing installed consistent with city code. 9. Standard Conditions: a. No building permits shall be issued until the final plat, agreements, and easements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Compliance with the city's tree preservation regulations. c. Tree preservation and silt fencing shall be maintained throughout constriction. d. No trees shall be planted in the boulevard. e. Removal of all hazardous trees from the property at the owner's expense. f. Any signage shall require separate permits and shall comply with the city's signage regulations. g. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
