HomeMy WebLinkAboutCity Council Resolution 2013-255CITY OF PLYMOUTH RESOLUTION No. 2013-255 A RESOLUTION APPROVING A PRELIMINARY PLAT AND FINAL PLAT FOR RYLAND HOMES FOR "CREEK RIDGE SECOND ADDITION" FOR TWO SINGLE FAMILY LOTS FOR PROPERTY LOCATED AT 5405 AND 5335 VICKSBURG LANE NORTH (2013058) WHEREAS, Ryland Homes has requested approval of a preliminary plat for the roughly 1.3 -acre parcel presently legally described as follows: Parcel A: The South 526.00 feet of the Southeast quarter of the Southeast quarter of Section 5, Township 118, Range 22, Hennepin County, Minnesota. Parcel B: That part of the following described property: That part of the East 660 feet of the North '/z of Northeast Quarter of Section 8, Township 118, Range 22, lying northerly of a line 30 feet Northerly of, measured radial to and parallel with the Northerly right of way line of the Soo Line Railroad. (Minneapolis, St. Paul & Sault Ste. Marie Railroad Company), Hennepin County, Minnesota. Which lies westerly and northerly of the following described line: Commencing at the Northeast Quarter of said Section 8; thence westerly, along the north line of said North '/z a distance of 372.93 feet to the point of beginning of said line; thence deflecting to the left 68 degrees 07 minutes 29 seconds a distance of 230.37 feet; thence deflecting to the right 57 degrees 25 minutes 15 seconds a distance of 202.55 feet to the West line of said East 660 feet, and said line there terminating, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryland Homes for a preliminary plat and final plat for "Creek Ridge Second Addition", subject to the following conditions: 1. A preliminary and final plat is approved to allow the property at 5405 and 5335 Vicksburg Lane North to be subdivided into two single-family lots, in accordance with the application and plans received by the city on June 21, 2013, except as may be amended by this resolution. 2. Approval of the preliminary and final plat is contingent upon City Council approval of the rezoning of the site to RSF-3. 3. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances are approved or implied. Res. 2013-255 File 2013058 Page 2 4. The City Council waives the requirement for a sidewalk with this plat. A sidewalk will be constricted on the opposite side of the street (53rd Place North) from the subject homes, as part of the Creek Ridge subdivision. 5. The city will hold a financial guarantee for private improvements such as site grading and tree preservation with the Creek Ridge development contract. 6. Until a permanent gravity sewer service is provided, sanitary sewer service for the two subject lots shall be provided by the Creek Ridge temporary lift station. The two lots shall be added to the home owner's association for the Creek Ridge development. 7. The temporary constriction access from Vicksburg Lane to serve Creek Ridge shall also be used as the temporary constriction access for Creek Ridge 2nd Addition. The temporary constriction access shall be constricted, prior to tree removal or any site grading. All constriction vehicles shall access the site via this temporary access while this access is open. The temporary constriction access shall remain open until: 1) 70% of the homes in the subdivision have received final building occupancy; 2) the streets in the development have been through one winter cycle; and 3) a street connection is made into the Kirkwood subdivision. 8. The applicant shall record the subject Creek Ridge Second Addition final plat at the same time as the Creek Ridge final plat. 9. Prior to issuance of a 2radin2 permit, the applicant shall install and request inspection of silt fencing and tree preservation fencing. 10. Prior to recording the final plat, the applicant shall: a) Record a lot line adjustment between 5405 and 5335 Vicksburg Lane. b) Pay the park dedication cash fee. c) Pay watermain and sanitary sewer area charges in the amount of $5,404.32. d) Receive city approval of final constriction plans. e) Revise the final plat to show the east/west street to be named 53rd Place North. f) Fire flow calculations shall be approved by city staff Based on water pressures and the timing of the watermain constriction to the site from the adjacent Kirkwood subdivision, the city may require additional watermain looping. 11. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted, and b. Silt fence and tree preservation fencing installed consistent with city code. 12. Standard Conditions: a. No building permits shall be issued until the final plat, agreements, and easements are filed and recorded with Hennepin County. b. Compliance with the city's tree preservation regulations. Res. 2013-255 File 2013058 Page 3 c. Building permits are required for retaining walls higher than 48 inches in height. Additionally, a fence with a minimum height of three feet shall be installed at the top of retaining walls that exceed four feet in height. d. Removal of all hazardous trees from the property at the owner's expense. e. This approval shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
