A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND VARIANCE TO ALLOW A
WATER -ORIENTED ACCESSORY BUILDING FOR THREE RIVERS PARK DISTRICT AT CLIFTON
E. FRENCH REGIONAL PARK LOCATED ON THE NORTH SIDE OF MEDICINE LAKE

WHEREAS, Three Rivers Park District has requested approval of a conditional use
permit and variance to allow a 360 -square foot, water -oriented accessory building at Clifton E.
French Regional Park located on the north side of Medicine Lake; and
WHEREAS, the subject property is legally described as follows:
The property is legally described as: That part of Government Lot 2, Section 23,
Township 118 north, Range 22, West of the 5th Principal Meridian, lying westerly of the
following described line: Beginning at a point on the North line of said Government Lot
2 distant 1030 feet East of the Northwest corner of said Government Lot 2; thence South
0 degrees 07 minutes 36 seconds East (assuming the North line of said Government Lot 2
has a bearing of North 89 degrees 36 minutes 10 seconds East) a distance of 600 feet;
thence South 45 degrees 56 minutes 27 seconds East a distance of 200.00 feet; thence
South 31 degrees 41 minutes 32 seconds East a distance of 256.78 feet more or less to the
east line of said Government Lot 2, Thence Southerly along sais east line of Government
Lot 2 a distance of 267.00 feet; thence South 30 degrees 24 minutes 09 seconds West a
distance of 208 feet; thence South 0 degrees 07 minutes 36 seconds East a distance of 203
feet more or less to the shore of Medicine Lake and there terminating, Hennepin County,
Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request
for a conditional use permit and variance for a 360 -square foot, water -oriented accessory
building located at Clifton E. French Regional Park, subject to the following conditions and
findings:
I. The conditional use permit allows a water -oriented accessory building, in accordance with
the application and plans received by the city on May 21, 2013, and revised elevation plan
received on July 15, 2013, and revised site and floor plans received on July 23, 2013, except
as may be amended by this resolution, based on the finding that all applicable conditional
use permit standards have been met.

2. The variance allows a 360 -square foot, water oriented accessory building to be located 41
feet from the ordinary high water level of Medicine Lake, where 50 feet is required by the
zoning ordinance, in accordance with the application and plans received by the city on May
21, 2013, and revised elevation plan received on July 15, 2013, and revised site and floor
plans received on July 23, 2013, except as may be amended by this resolution, based on the
finding that all applicable variance standards have been met.
3. A building permit is required prior to commencement of the proiect.
4. The conditional use permit and variance shall expire one year after the date of approval,
unless the property owner or applicant has started the project, or unless the applicant, with
the consent of the property owner, has received prior approval from the city to extend the
expiration date for up to one additional year, as regulated under sections 21015.07 and
21030.06, respectively, of the zoning ordinance.
