JOHNSON LANDSCAPE DESIGN GROUP FOR MESSIAH UNITED METHODIST CHURCH LOCATED AT 17805 COUNTY ROAD 6 (2013054) WHEREAS, the C. Johnson Landscape Design Group, on behalf of Messiah United Methodist Church, has requested approval of a conditional use permit for a memorial garden with columbaria on the site legally described as follows: That part of the Southeast Quarter of the Southeast Quarter of Section 30, Township 118, Range 22, which lies South of the center line of County Road No. 6, as now laid out and opened, which center line is described as follow: Beginning at the Southeast coiner of said Section 30: thence North along the East line thereof, a distance of 1062.0 feet, to the actual point of beginning of the line to the described: thence deflecting to the left at an angle of 86 degrees 31 minutes, a distance of 1188.10 feet: thence deflecting to the left along a 3 degree crave. a distance of 621.10 feet (delta angle of 18 degrees, 38 minutes, tangent distance 313.30 feet): thence along tangent to the last mentioned crave to the West line of Government Lot 4. in Section 30 and there terminating. Described as follows: Beginning at the intersection of the above described center line of County Road No. 6, with the West line of the Southeast Quarter of the Southeast Quarter of said Section 30: thence Easterly along said center line to a point on said center line which point is 640.00 feet East of the West line of the Southeast Quarter of the Southeast Quarter of said Section 30, as measured at right angles to said West line: thence South and parallel to the West line of said Southeast Quarter of the Southeast Quarter, a distance of 380.07 feet: thence Northwesterly a distance of 640.75 feet to a point on the West line of said Southeast Quarter of the Southeast Quarter, which point is 380.01 feet South from the point of beginning: thence North along said West line, a distance of 380.01 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by C. Johnson Landscape Design Group, on behalf of Messiah United Methodist Church, for a conditional use permit to allow a memorial garden with columbaria on property located at 17805 County Road 6, subject to the following conditions: 1. A conditional use permit is approved to allow a memorial garden with columbaria, in accordance with the application and plans received by the City on June 13, 2013, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. Res. 2013-243 File 2013054 Page 2 3. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 4. Prior to installation of the memorial wall or columbaria, the applicant must obtain separate approval of a building permit. 5. Prior to issuance of a building permit, the applicant shall submit the following consistent with the zoning ordinance and city codes: a. A watts per square foot analysis and fixture details of the lighting proposed. b. A copy of a approved permit from Minnehaha Creels Watershed District. 6. Standard Conditions: a. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. b. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
