Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 13th day
of DecembeE 1988 The following members were present:
Mayor Schneider, Councilmember4 Vaciliou' Rickar and Zitur
The following members were absent: CnnncilmPmhPr Sick
Councilmemher Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 88-900
DECLARING PROPERTY SURPLUS AND AUTHORIZING SALE (OUTLOT A, PLYMOUTH HILLS
FOURTH ADDITION)
WHEREAS, the City acquired property described as Outlot A, Plymouth Hills
Fourth Addition utilizing Community Development Block Grant Funds pursuant to
a land disposition agreement dated September 7, 1982 with Hennepin County;
and,
WHEREAS, the Land Disposition Agreement, contract No. 20393, provided an
initial three year period for completion of the project, the development of
low to moderate income senior citizen housing; and,
WHEREAS, the City Council approved an amendment to this disposition agreement
under Resolution No. 85-876 which extended the period for three years; and,
WHEREAS, the extended period has expired and the property has not been
developed with low to moderate income senior citizen housing; and,
WHEREAS, the land disposition agreement provides that the property may be
developed with an alternative eligible CDBG use or the property may be sold
for fair market value with the proceeds from the sale being considered program
income to be handled pursuant to the joint cooperation agreement the City has
with Hennepin County relative to the administration of the CDBG program; and,
WHEREAS, the City is not interested in retaining the property; and,
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does declare as surplus the
property described as Outlot A, Plymouth Hills Fourth Addition and authorizes
the Mayor and City Manager to undertake the disposition of the property
through sale;
FURTHER, BE IT RESOLVED the City shall first receive verification from
Hennepin County that any shortfall between the price realized by the sale of
the land and the amount paid for the land will not be the responsibility of
the City.

FURTHER, BE IT RESOLVED the property will be sold through means which are
found to provide the highest and best return.
FURTHER, BE IT RESOLVED the use of the land for an alternative CDBG use is not
precluded if a bona fide proposal were submitted to the City without delaying
efforts to sell the property.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilme.,ber Ricker , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider, Councilmembera Vaailiou,
Ricker and Zitur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.*
