Ricker and Zitur The following members were absent: Councilmember Sisk rmmrilmPmhPr RirkPr introduced the following Resolution and moved its adoption: RESOLUTION 88-878 APPROVAL OF A YARD SETBACK VARIANCE FOR Thomas Rucke (11-03-88) WHEREAS, Thomas Rucke pursuant to Section 11, Subdivisions C. of the Plymouth Zoning Ordinance has appealed the November 29, 1988 ruling of the Board of Zoning Adjustments and Appeals denying his request for a variance from the minimum front yard setbacks at 12215 29th Avenue North from 35 feet to 32.35 feet; and, WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter at a duly called hearing; and, WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjustments and Appeals, as well as the petitioners application for the variance; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that is should and hereby does approve the variance for Thomas Rucke for a variance for a maximum 2.65 foot encroachment into the required front yard setback based on the following findings: 1. Ordinance variance criteria have been met. 2. The construction could occur without any variance if the public trail had been dedicated by easement rather than by outlot. 3. The magnitude of the requested variance is negligible at 2.65 feet. 4. The home abuts West Medicine Lake Drive, a minor arterial street. The motion for adoption of the foregoing Resolution was duly seconded by cnnnrilmnmhar Zitur , and upon vote being taken thereon, the following voted in favor thereof: mayor Schneider. Councilmembers Vasiliou, The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
