Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 19th day
of DecembeF 19Lq._ The following ambers were present:

Councilmemberyasiliou introduced the following Resolution and
moved its adoption:
RESOLUTION 88-875
SETTING CONDITIONS TO BE MET PRIOR TO FIITNG OF AND RELATED TO FINAL PLAT FOR
HARBOR PLACE FOR HANS HAGEN HOMES (87124) (RPUD 88-3)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Harbor Place as requested by Hans Hagen;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
I. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing the Final Plat.
4. No Building Permits shall be issued until a Contract has been awarded for
the construction of municipal sewer and water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
7. No yard setback variances are granted or implied.
B. Approved minimum setbacks are:
a. Front yard setback on Glacier Lane - 30 feet
b. Front yard setback on all other streets - 35 feet
c. Side yard setback - 10 feet
d. Rear yard setback - 15 feet
9. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.

10. No Building Permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
11. Appropriate legal documents regarding Homeowner Association covenants and
restrictions as approved by the City Attorney, shall be filed with the
Final Plat.
12. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 88-3 per Section 9 of the Zoning Ordinance.
13. Lot coverage maximum shall be not in excess of Zoning Ordinance standards,
and may be exceeded only upon approval by the City Council, on a lot -by -
lot basis, after mass grading has been completed. The request for ground
coverage in excess of Zoning Ordinance standards must demonstrate the
merits of the request in terms of preservation of natural amenities.
14. A private trail shall be constructed to a width of 6 feet and to City
specifications within the Outlot A between Lot 7, Block 3 and Lot 8, Block
2. Construction of this trail shall be complete prior to issuance of
Building Permits for Lot 7, Block 3 and Lot 8, Block 2.
15. The Development Contract terms shall be extended to include provisions for
tree preservation consistent with existing procedures, including a bond
securing performance and a penalty of $200 per caliber inch for removal of
trees designated for preservation.
The motion for adoption of the foregoing Resolution was duly seconded

Whereupon the Resolution was declared duly passed and adopted.
