Pursuant to due call and notice thereof, a reanlar meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 19th day
of Izcember 19.x,$.- The following members were present:
Mayor Gchneider- Councilmembers Vasiliou- Ricker and Zitnr
The following members were absent: Councilmemb Sim

moved its adoption:
RESOLUTION 88-872
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
TYRELL EIGHTH ADDITION FOR HANS HAGEN HOMES (88136) (RPUD 79-2))
WHEREAS, the City Council has approved the RPUD, Final Plat/Plan and
Development Contract for Tyrell Eighth Addition as requested by Hans Hagen;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing the Final Plat.
3. No Building Permits shall be issued until a Contract has been awarded for
the construction of municipal sewer and water, and the MPCA Permit issued.
4. Removal of all dead or dying trees from the property at the owner's
expense.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.
6. No yard setback variances are granted or implied: Minimum setbacks shall
be consistent with the approved Amhurst/Tyrell RPUD Plan:
a. Front Setback - 35 flet
b. Side Setback - 10 feet (living) and 6 feet (garage)
c. Rear Setback - 25 feet
7. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
8. No Building Permits to be issued until the Final Plat is filed and recorded
with Hennepin County.
9. Appropriate legal documents regarding Homeowner Association covenants and
restrictions as approved by the City Attorney, shall be filed with the
Final Plat.

10. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 79-2 per Section 9 of the Zoning Ordinance.
11. The total number of lots in all future additions of the Amhurst/Tyrell
RPUD (79-2) shall not exceea 12.
12. The contract for the Amhurst 2nd Addition required the developer to grade
the trail from the south plat boundary to the park adjacent to Turtle
Lake. Also, the developer was given credit towards park fees for the
paving of the trail. This trail construction has not been completed.
Before any building permits are issued in Tyrell 8th Addition, any
easements necessary for the trail and a letter of credit or cash payment
shall be provided to the City to insure completion of the trail.
The motion for adoption of the foregoing Resolution was duly seconded
