HomeMy WebLinkAboutCity Council Resolution 1988-863CITY OF PLYMOUTH OF- Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the19th day of December , 1988. The following members were present: Navor Schneider Councilmembers Vasiliou , Ricker and Zitur The following members were absent: Councilmember Sisk Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-863 AUTHORIZING THE VACATION OF A PORTION OF 8TH AVENUE (YALE AVENUE) ADJACENT TO LOTS 1, 2 AND 3 PLYMOUTH GARDEN ADDITION WHEREAS, a petition was received to vacate the following street right-of-way: All that part of 8th Avenue (Yale Avenue) described as follows: That part of 8th Avenue (Yale Avenue), Plymouth Gardens, according to the plat on file and of record in the office of the County recorder Hennepin County, Minnesota lying east and north of the plat of Groves Office Park; south of Lot 1, Plymouth Gardens and west of State Highway No. 18 Plat 19. WHEREAS, a public hearing with respect to said vacation was scheduled for December 19, 1988 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of December 19, 1988, and WHEREAS, the Council did hold a public hearing on December 19, 1988 to inform any and all interested parties relevant to the vacation of said street; and WHEREAS, it was determined by the City Council that said street is not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following street is hereby vacated: 1. That part of 8th Avenue (Yale Avenue), Plymouth Gardens, according to the plat on file and of record in the office of the County recorder Hennepin County, Minnesota lying east and north of the plat of Groves Office Park; south of Lot 1, Plymouth Gardens and west of State Highway No. 18 Plat 19. 2. The City shall reserve a utility easement over said vacated street. The motion for the adoption of the foregoing Resolution was duly seconded by .7.16— , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker and Zitur , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
