HomeMy WebLinkAboutCity Council Resolution 1988-861CITY OF PLYMOUTH Pursuant to due call and notice thereof, a reuular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19th day of December , 1988. The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker and Zitur The following members were absent: Councilmember Sisk A** MT -1 Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-861 RESOLUTION ESTABLISHING DEVELOPMENT DISTRICT NO. 7; ADOPTING A DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO. 7; AND ADOPTING MODIFIED PLANS FOR TAX INCREMENT FINANCING DISTRICT NOS. 1-2, 1-2A, 1-3, 1-4, 1-5, 2, 2-1, 3-1, 3-2. 3-3, 4-1. 4-2. 4-3, 5-1 and 6-1 BEFIT RESOLVED By the City Council of Plymouth. Minnesota, as follows: Section 1. Recitals. 1.01. The City of Plymouth (City) has previously approved the creation of six Development Districts and has adopted a program for each district in accordance with Minn. Stat., Sections 469.124 through 462.134. 1.02. The City also approved the creation of fifteen Tax Increment Financing Districts within the six Development Districts and adopted a plan for each TIF District pursuant to Minn. Stat., Sections 469.174 and 469.179. 1.03. The City finds that having fifteen TIF Districts within six distinct Development Districts impedes the City in its efforts to coordinate its development efforts. 1.04. The City has authorized the preparation of a program (Program) for a new Development District which will incorporate the areas within the six previously established Development Districts. which Program is contained in a document entitled "City of Plymouth, Minnesota, Development Program, Develop- ment District No. 7," dated October 25, 1988, and which is on file in the office of the City Manager. 1.05. The City has also authorized the preparation of modifications to the tax increment financing plans (Plans) for TIF district Nos. 1-2, 1-2A, 1-3. 1-4. 1-5. 2, 2-1. 3-1, 3-2, 3-3. 4-1. 4-2, 4-3, 5-1 and 6-1, copies of which modified Plans are on file in the office of the City Manager. 1.06. The Program and modified Plans were referred to the Plymouth planning commission which on November 23, 1988, found that they conform to and are not in conflict with the general plan for the development of the City as a whole. 1.07. The City has performed all actions required by law to be performed prior to the establishment of Development District No. 7 and the adoption of Resolution No. 88-861 Page 2 the Development Program and modified Tax Increment Financing Plans relating to the TIF districts, including notification of Hennepin County and Independent School District Nos. 270, 279, 281 and 284 and holding a public hearing regarding the Program and the modified Plans upon such notice as it required by law. 1.08. The City Council has fully reviewed the contents of the Program and the trodified Plans and has this date conducted a public hearing thereon at which the views of all interested persons were heard. Section 2. Findings; Development District. 2.01. It is hereby found and determined that within Development District No. 7 there exists properties which have not been utilized to their full development potential because of a lack of public improvements, especially public streets and roadways. 2.02. It is further specifically found and determined that: a) the land in the District would not be made available for development without the public intervention and financial assistance described in the Program; b) the Program will afford maximum opportunity, consistent with the sound needs of the City as a whole, for the development of the District by private enterprise; and c) the Program conforms to the general plan for development of the City as set forth in the comprehensive municipal plan. Section 3. Findings; Modified Tax Increment Financing Districts. 3.01. The City Council finds that the Plans for TIF District Nos. 1-2, 1-2A, 1-3. 1-4, 1-5. 2, 2-1, 3-1, 3-2. 3-3. 4-1, 4-2, 4-3, 5-1 and 6-1, are being modified to provide for the financing of additional public improvements designed to encourage development of Development District No. 7. No land is being added to any TIF district as a result of this modification. 3.02. The Council finds that the modified Plans for the TIF districts conform to the general plan for development of the City. 3.03. The Council finds that the modified Plans for the TIF districts will afford maximum opportunity, consistent with the sound needs of the City as a whole, for development of the Development District by private enterprise. 3.04. The Council further finds that the modification of the Plans for the TIF districts is intended and, in the judgment of the Council, its effect will be to promote the public purposes and accomplish the objectives specified In the TIF Plans. 2 Resolution No. 88-861 Page 3 Section 4. Establishment of Development District; Adoption of Program and Modified Plans. 4.01. Development District No. 7 is hereby established. 4.02. The Development Program for Development District No. 7 and the modified Plans for TIF District Nos. 1-2, 1-2A, 1-3, 1-4, 1-5, 2, 2-1, 3-1, 3-2. 3-3, 4-1, 4-2, 4-3, 5-1 and 6-1 are hereby approved and adopted. 4.03. The geographic boundaries of Development District No. 7 are described in the Program therefor and are incorporated herein by reference. No additional property has been added to the TIF districts as a result of this modification. 4.04. The establishment of Development District No. 7 is not intended to Impair the operation or functions of Development District Nos. 1 through 6. These Development Districts continue to exist under their respective programs and nothing contained herein or in the Program for Development District No. 7 shall be construed as in conflict with any contract entered into or project undertaken by the City pursuant to those programs. 4.05. The City Manager is authorized and directed to file copies of the Program and modified PIP -ns with the Minnesota commissioner of trade and economic development.
