HomeMy WebLinkAboutCity Council Resolution 1988-851CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 5th day of December , 1988. The following members were present: , Mayor Schneider, Councilmembers Vasiliou and Sisk , The following members were absent: Councilmembers Ricker and Zitur CouncitmpmhE+r Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 88-851 DECLARING PROPERTY SURPLUS AND AUTHORIZING SALE SCHMIDT LAKE ROAD EAST OF ZACHARY LANE WHEREAS, the City of Plymouth purchased property recorded as Document No's 3470869, 3470872 and 3470873 for the construction of Schmidt Lake Road east of Zachary Lane; and WHEREAS, development plans have been approved for development of the property at the same location which will require relocation of the proposed road; and WHEREAS, a portion of the previously purchased property will no longer be necessary for the road; and WHEREAS, development plans hive been approved which incorporates this excess property into the developmc�:t at each side of the new road; and WHEREAS, it is in the best interest of the City to transfer ownership of the pr, perty. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA AS FOLLOW:: 1. That the property described in Document No's 3470869, 3470872 and 3470873 is hereby declared as surplus property. 2. That the Mayor and City Manager are authorized to execute a deed transferring ownership of the property to the owner of the immediate adjacent property. 3. That after transfer of ownership by the City the property must be incorporated with the adjacent property when it is platted for development. 4. That the plat shall provide the right-of-way necessary for the new road alignment. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon xote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
