HomeMy WebLinkAboutCity Council Resolution 1988-828CITY OF PLYMOUTH Pursuant to due call and notice thereof, a _ regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 21st day of November , 1988. The following members were present: Mayor Schneider Coun ilmembe c Vasiligu, Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 88- 828 AUTHORIZING CONDEMNATION PROCEEDINGS 11TH AVENUE NORTH/NATHAN LANE INTERSECTION IMPROVEMENTS CITY PROJECT NO. 648 WHEREAS, the City of Plymouth has undertaken City Project No. 648; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper and expedient ir: the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the City Attorney is hereby authorized to commence condemnation proceedings for City Project No. 648 for the following described easements within the following described parcel: (PIN X25-118-22-44-0004 and 36-118-22-11-0029) Tract D Registered Land Survey No. 1251 files of register of titles, Hennepin County, Minnesota Tract A Registered Land Survey No. 1254 files of register of titles, Hennepin County, Minnesota Description of Easement: A perpetual easement for public right, -of -way purposes over, under and across that part of the above described property lying northeasterly, northerly and northwesterly of the following described line: Commencing at the north corner of said Tract D; thence south 66 degrees 47 minutes 40 seconds east, record bearing, a distance of 327.97 feet along the northeasterly line of said Tract D; thence southeasterly, continuing along said northeasterly line, a distance of 192.03 feet along a curve concave northeasterly having a central angle of 9 degrees 16 minutes 39 seconds and a radius of 1185.92 feet to the point of beginning of the line to be described; thence northwesterly, back along said northeasterly line a distance of 192.03 feet along said curve concave northeasterly having a radius of 1185.92 feet; thence northwesterly and southwesterly a distance Resolution No. 88-828 Page Two of 450.23 feet along a reverse curve southeasterly having a central angle of 90 degrees, a radius of 287.97 feet and cord bearing of south 68 degrees 12 minutes 20 seconds west to a line 50 feet easterly of and parallel with the westerly line of said Tract A; thence south 23 degrees 12 minutes 20 seconds west along said parallel line to the southerly line of said Tract A and said line there terminating and Together with a temporary easement for construction purposes over, under and across that part of the above described property lying northeasterly, northerly and northwesterly of a line 40 feet southwesterly, southerly and southeasterly of the above described line. The above described temporary easement shall ter-Inate on December 31, 1989, or upon completion of construction, whichever occurs first. The motion for the adoption of the foregoing Resolution was duly seconded by Coun_cilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: _Mayor Schneider.
