HomeMy WebLinkAboutCity Council Resolution 1988-793CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 7th day of November, 19.$J_ The following members were present: Ma nr crhneider_ Councilmembers Vasiliou, Ricker, Zitur and Sisk _ The following members were absent: None CminrilmPmbpr siQk introduced the following Resolution and moved its adoption: RESOLUTION 88-793 APPROVING ALTERNATIVE FINAL PLAT TIMING FOR "ZACHARY HEIGHTS" (88042) WHEREAS, Graham Development Company has requested permission to Final Plat only the North Half of the approved Preliminary Plat "Zachary Heights"; and, WHEREAS, the City Council finds that unique circumstances exist with respect to the ownership status of the parcels of land comprising "Zachary Heights" resulting in a hardship to Graham Development Company; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does concur with the final platting of the North Half of the "Zachary Heights" Preliminary Plat (88042) without inclusion of the South One Half within the Final Plat subject to the following conditions: 1. Conformity of the Final Plat with design of the "Zachary Heights" Preliminary Plat. 2. Platting of Lots 5, 6, 7, and 8. Block 2 and Lot 13, Block 1, as Outlots with consolidation where appropriate. 3. Construction of temporary cul-de-sacs at the south end of Ximines Lane. 4. Dedication of right-of-way for, and construction of Schmidt Lake Road to the southeast corner of the plat - adjacent to Lot 8, Block 2 as depicted on the draft Final Plat. 5. A binding agreement by Graham Development providing that should the City of Plymouth determine a need to acquire the portion of the Schmidt Lake Road right-of-way not included in the portion of "Zachary Heights" Final Plat, Graham Development will reimburse the City of Plymouth for those Resolution No. 88-793 Page 2 acquisition costs to the extent to which the City is not able to assess those costs to the McNeal, Inc. property, if Graham Development finally plats the McNeal property. 6. The land north of Sci.midt Lake Road shall be platted as outlots except that Ximines LaA-P be Flatted as right-of-way. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Maynr Rrhnpidgr- coon ilmPmhPra UnailJou, Ricker, Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
