HomeMy WebLinkAboutCity Council Resolution 1988-765CITY OF }'1;:MOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 7th day of November , 1988. The following members were present: Mayor Schneider, Councilmembers Vasiliou , Ricker, Zitur and Sisk The following members were absent: None Councilmember Zitur adoption: introduced the following Resolution and moved its RESOLUTION NO. 88-765 AUTHORIZING THE VACATION OF STREET RIGHT-OF-WAY 26TH AVENUE ADJACENT TO PARCEL 27-118-22-12-0001 WHEREAS, a petition was received to vacate a portion of 26th Avenue; and WHEREAS, a public hearing with respect to said vacation was scheduled for Nov. 7, 1988 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of Nov. 7, 1988; and WHEREAS, the Council did hold a public hearing on Nov. 7, 1988 to inform any and all interested parties relevant to the vacation of 26th Avenue; and 1bWHEREAS, it was determined by the City Council that said right-of-way for 26th Avenue as described below is not needed for public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That a portion of 26th Ave. described as follows is hereby vacated: Commencing at the Northeast corner of the Northeast Quarter of Section 27, Township 118, Range 22; thence North 89 degrees 47 minutes 54 seconds West, assumed bearing, along the North line of said Northeast Quarter a distance of 1098.00 feet; thence South 0 degrees 12 minutes 06 seconds West 33.00 feet to the South line of 26th Avenue North and the point of beginning of that part of said 26th Avenue North to be described; thence North 0 degrees, 12 minutes 06 seconds East 3.00 feet; thence North 89 degrees 47 minutes 54 seconds West 296.33 feet; thence northwesterly along a tangential curve concave to the Northeast having a radius of 332.52 feet and a central angle of 24 degrees 31 minutes 21 seconds a distance of 142.34 feet to the North line of said Northeast Quarter; thence North 89 degrees 47 minutes 54 seconds West along said North line 250.17 feet to the northeasterly right- of-way of State Highway No. 55; thence southeasterly along said northeasterly right-of-way line to its intersection with the South line of said 26th Avenue North; thence South 89 degrees 47 minutes 54 seconds East to the point of beginning. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or Chereunder, to continue maintaining the same to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. 3. That the City of Plymouth reserves easement rights for utility purposes over, under and across said vacated street. The motion for the adoption of the foregoing Resolution was duly seconded by Council , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker. Zitur and Sisk , The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
