Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota was held on the 7th day of November ,
1988. The following members were present: Mayor, �chneider, Councilmembers Vasi iou
Ricker, Zitur and Sisk _
The following members were absent: None
Councilmember Zitur introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 88-764
AUTHORIZING THE VACATION OF A STREET EASEMENT
NORTH OF 25TH AVENUE, WEST OF HWY. 494
IN THE NORTHWEST 1/4 OF SECTION 27 TOWNSHIP 118 RANGE 22
WHEREAS, a petition was received to vacate a street easement; and
WHEREAS, a public hearing with respect to said vacation was scheduled for Nov. 7, 1988
in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of Nov. 7, 1988; and
WHEREAS, the Council did hold a public hearing on Nov. 7, 1988 to inform any and all
interested parties relevant to the vacation of said street easement; and
WHEREAS, it was determined by the City Council that said street easements were not
needed for public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the street easement described as follows is hereby vacated:
The east 50 feet of that part of the north 1/2 of the north 1/2 of the north
west 1/4 of the northwest 1/4 of Section 27, Township 118 north, Range 22,
west of the 5th principal meridian, lying west of the west line of U. S.
Highway 494 and east of a line drawn parallel with the west line of said
section from a point on the north line !.'iereof distant 435 feet east of the
northwest corner thereof.
2. That said vacation shall not affect the authority of any person, corporation or
municipality owning or controlling the electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue maintaining the same to enter upon such way or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
3. That the City of Plymouth reserves easement rights for utility and drainage purposes
over, under and across said vacated street.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Ricker , and upon vote being taken thereon, the following voted
in favor thereof: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk ,
The following voted against or abstained: _ None
Whereupon the Resolution was declared duly passed and adopted.
