HomeMy WebLinkAboutCity Council Resolution 1988-684CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 17th day of October , 1988 The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Vasiliou introduced the following Resolution and moved Its adoption: RESOLUTION NO. 88-683 IMPOSING PENALTY FOR LIQUOR LAW VIOLATION BY COLONY LIOUOR WHEREAS, the Plymouth City Code provides that an off -sale liquor license Issued by the City may be denied, suspended or revoked by the Council for any violation pertaining to the activity of the license held, and WHEREAS, Plymouth City Code Section 1005.23 provides that no license may be suspended or revoked until after a hearing is held; and WHEREAS, a liquor law violation relating to the sale of liquor to a minor occurred at Colony Liquor on May 13, 1988; and WHEREAS, in accordance with the City Code, a hearing was held on October 17, 1988, to determine whether the license should be suspended or revoked. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that a $1,000 fine is hereby imposed against Colony Liquor. The fine is stayed on the following conditions: 1. That the licensee have no liquor law violations during the next 12 months. 2. That the licensee pay $500 to the City of Plymouth for donation to the Independent School District 279 Chemical Abuse Prevention Program. 3. That Colony Liquor immediately initiate a written, aggressive Identification carding program shared with their clerks including disciplinary action for clerk failure to card customers. The written program is to be submitted to the City Clerk within 30 days of passage of this resolution. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasiliou Ricker. Zitur and Sisk The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted. CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 17th day of October, 19 88 The following members were present: Mayor Schneider, Councilmembers Vasiliou, Ricker, Zitur and Sisk The following members were absent: None Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION 88- 684 APPROVING MIXED USE PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT AMENDMENT FOR RNWNL LTD. PARTNERSHIP/RYAN CONSTRUCTION (88049) WHEREAS, RNWNL Ltd. Partnership/Ryan Construction has requested approval for a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for Groves Office Park Second Addition for Amended Building Height from 11 stories (140 feet) to 12 stories (161 feet), and adding a Class I Restaurant of 10,000 Square Feet located west of the County Road 18 Service Road at 8th Avenue North; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the mixed use Planned Unit Development Preliminary Plan Plat and Conditional Use Permit and amendment for RNWNL Ltd. Partnership/Ryan Construction located west of the County Road 18 Service Road at 8th Avenue North, subject to the following conditions: 1. A variance from Zoning Ordinance Parking Standards is hereby granted to permit deferral of construction of the 180 at -grade parking spaces depicted on the north side of the Final Plan until the City determines the constructed parking is deficient per Ordinance off-street parking standards. 2. A variance from Subdivision Code Design Standards is hereby granted to permit Final Plat approval without an easement for drainage and utility purposes along a portion of the south property line of Lot 1, Block 1, based on an existing easement for these purposes of more than 63 feet across the parcel directly abutting on the south. 3. A variance is hereby granted to provisions of the City Code regarding fire lanes to allow construction of the Stage II building without a fire lane along the west side, as recommended by the Fire Chief. Resolution No. 88- 684 Page Z The motion for adoption of the foregoing Resolution was duly seconded by rnunrilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vaciliou. Ricker. Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
