Pursuant to due call and notice thereot, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the 3rd day
of October, 19 88 The followinc; members were present:

SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO RESIDENTIAL
PLANNED UNIT DEVELOPMENT (RPUD) FINAL PLAN/PLAT FOR DEERWOOD TRAILS FOR EDWARD
JOHNSTON (88016) (RPUD 88-1)
WHEREAS, the City Council has approved the RPUD Final Plat and Development
Contract for Deerwood Trails as requested by Edward Johnston;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Provisions for a 30 -ft. wide trail outlot per Comprehensive Park Plan, as
verified by the Parks and Engineering Departments, with submittal of
detailed plans as to construction of the trail per City standards.
3. Payment of park dedication fees -in -lieu of dedication with appropriate
credits in an amount determined according to verified acreage and paving
costs and according to the Dedication Policy in effect at the time of
filing the Final Plat.
4. No Building Permits shall be issued until a Contract has been awarded for
the construction of municipal sewer and water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures in subdivisions adjacent to, or containing
any open storm water drainage facility.

1. Approved Set Backs/lot coverage shall be per the Development Contract.
8. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
9. No Building Permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
10. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 88-1 per Section 9 of the Zoning Ordinance.
11. Compliance with City of Plymouth procedure with regard tr preservation of
trees of 8" in diameter outside the construction zone, ir,ciuding the
penalty payment of $50 per diameter inch where the proced •e is violated.
The developer will enter in to an Agreement with the City in this regard
prior to commencement of site grading.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember zitur , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Schneider, Councilmembers
Vaailiou. Ricker. zitur and Sisk
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
