Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 3rd day of nrtnher,
19-j8— The fallowing members were present:
Mayor Schneider, Councilmembers Vasiliou- Rieker, Zitur and sisic
The following members were absent: None
Councilmember Sisk introduced the following Resolution and moved
its adoption:
RESOLUTION 88- 609
DENYING A CONDITIONAL USE PERMIT FOR GARY BERTHIAUME FOR A HOME OCCUPATION AT 14120
COUNTY ROAD 9 (88110)
WHEREAS, Gary Berthiaume has requested a Conditional Use Permit for a Hone
Occupation to operate Northside Roofing and Snowplowing Company from the residence
at 14120 County Road 9; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends denial:.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does deny the request for Gary Berthiaume for a
Conditional Use Permit for a Home Occupation to operate Northside Roofing and
Snowplowing from the residence located at 14120 County Road 9, based on the
following findings:
I. The use will be detrimental to the public welfare, health and safety by the
outside storage of materials and waste.
2. The use will be injurious to the use and enjoyment of other residential classed
and zoned property in the neighborhood by the outside storage of materials and
commercial vehicles within clear view of those residential areas.
3. The use does not conform with the definition of Hone Occupation with respect to
the business use appearing to be clearly incidental and secondary to the
residential use of the site. The use proposed is found to present the
appearance of business as the primary use of the site.
The motion for adoption of the foregoing Resolution was duly seconded by
GnuncilmpmbPr Zitur , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Vasilinil,
Ricker. Zitur and Sisk . The
following voted against or abstained None Whereupon
the Resolution was declared duly passed and adopted.
