HomeMy WebLinkAboutCity Council Resolution 1988-608CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day of October, 19..88_ The following members were present: Mawr Schneider, Councilmembers Vasiliou. Ricker, Zitur and Sisk The following members were absent: None Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION 88-608 APPROVING A CONDITIONAL USE PERMIT FOR YIN WANG MOY FOR A CLASS II RESTAURANT AT OAKWOOD SQUARE SHOPPING CENTER (88107) WHEREAS, Yin Wang Noy has requested a Conditional Use Permit for a Class II restaurant to operate a Moy's Chinese Restaurant located at Oakwood Square Shopping Center; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and has made no recommendation: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Yin Wang Moy for a Conditional Use Permit for a Class II restaurant to operate a Moy's Chinese Restaurant at the Oakwood Shopping Center, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to Yin Wang Noy as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. All waste and waste containers shall be stored within approved designated areas. 5. Any signage shall conform with the City Ordinance standards. 5. There shall be no outsi0e display, sales, or storage of merchandise or related materials. 7. The permit shall be renewed in one year to assure compliance with the conditions. 8. A copy of any required current State license shall be provided prior to issuance of the Permit and shall be kept on file with the City. (continued on next page) Resolution 88-608 Page 2 of 2 9. Compliance with applicable Building and Fire Code requirements shall be verified by the City prior to Permit issuance. 10. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 11. Addition of 5 off-street parking ;paces and interior finish to "Flavors 'n Favors" consistent with the letter of Kilstofte and Associates dated September 26, 1988. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Utur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Vasilicn,, Ricker Utur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
