CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day of nrrnh.r, 19 88 The following members were present: Mayor Schneider, Councilmembers Vasiliou, RirkPr, 21tu r and Sick The following members were absent: Nonp Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION 88-606 APPROVING A CONDITIONAL USE PERMIT FOR MELVIN K. SCHMID FOR A CLASS II RESTAURANT AT WILLOW GROVE SHOPPING CENTER (88102) WHEREAS, Melvin K. Schmid has requested a Conditional Use Permit for a Class II Restaurant to operate a Tacos Plus restaurant located at the Willow Grove Shopping Center, 64 Nathan Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for Melvin K. Schmid for a Conditional Use Permit for a Class II restaurant in a B-2 Zone to operate a Tacos Plus at the Willow Grove Shopping Center, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to Melvin K. Schmid as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. All waste and waste containers shall be stored within approved designated areas. 5. Any signage shall conform with the City Ordinance standards and the approved plan for this Center•. 6. There shall be no outside display, sales, or storage of merchandise or related materials. 7. The permit shall be renewed in one year to assure compliance with the conditions, specifically the off-street parking operations and experience. (continued on next page) Resolution 88- 606 Page 2 of 2 8. Compliance with applicable Building and Fire Code requirements shall be verified by the City prior to Permit issuance. 9. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider. Councilmembers yasilinu Ricker, Zitur and Sisk The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
